HomeMy WebLinkAboutMINUTES - 02092010 - C.02RECOMMENDATION(S): DETERMINE that this summary vacation of an excess right of way of a street or highway is no longer required for street or highway purposes, is made pursuant to Division 9, Part 3, Chapter 4 of the Streets and Highways Code, commencing with Section 8330, et. seq. A description of the area to be vacated is attached hereto as Exhibit "A" and shown as Exhibit “B” and incorporated herein by reference. DETERMINE that this summary vacation request is for an excess right of way of a street or highway not required for street or highway purposes. (S&H Code Section 8334) DETERMINE that the proposed vacation will not have a significant effect on the environment, and that it has been determined to be exempt from the California Environmental Quality Act (CEQA) under State CEQA guidelines pursuant to Article 5, Section 15061 (b)(3), and DIRECT the Director of Department of Conservation and Development (DCD) to file a Notice of Exemption with the County Clerk, and APPROVE OTHER RECOMMENDATION OF CNTY ADMINISTRATOR RECOMMENDATION OF BOARD COMMITTEE Action of Board On: 02/09/2010 APPROVED AS RECOMMENDED OTHER Clerks Notes: VOTE OF SUPERVISORS AYE:John Gioia, District I Supervisor Gayle B. Project No. 0676-6P1600 [CP#09-82] AUTHORIZE the Public Works Director to arrange for payment of $25.00 fee to DCD for processing, and a $50.00 fee RECOMMENDATION(S): (CONT'D) to the County Clerk for filing the Notice of Exemption, and DECLARE that the hereinabove described proposed vacation area is HEREBY ORDERED VACATED subject to any reservation and exception described in attached Exhibit "A". From and after the date this Board Order is recorded, the area vacated no longer constitutes a public street. DIRECT the Real Property Division to record a certified copy of this Board Order in the office of the County Recorder. FISCAL IMPACT: The County will save the costs of maintenance along the street right of way. There is no impact to the County General Fund. BACKGROUND: In 1952, the County obtained an easement interest in the street right of way along a portion of Sixth Street lying between the easterly line of Vaqueros Avenue and the westerly line of Napa Avenue in the Rodeo area. The Board of Supervisors accepted the street into the County’s road system by Resolution on May 6, 1952 in Road Book 11, Page 105. The street was never constructed and it has been determined it is not needed for traffic circulation purposes. CONSEQUENCE OF NEGATIVE ACTION: The County would be responsible for the maintenance to a portion of street right of way off of Sixth Street located in the Rodeo area. ATTACHMENTS Exhibits and CEQA
