January 30, 1985 Suaject: Request to Cancel Two Deputy District Attorney Advanced Salary Assign- ment Positions and Add Two Deputy District Attorney-Fixed Term Positions Deputy District Attorney positions #069 & #194 are presently vacant. These are permanent positions and we currently do not have an eligible list, to fill them. We will not be able to conduct an examination for our permanent class of Deputy District Attorney - Basic Salary Assignment until the early part of FY 85-86. In the meantime, we are in part covering for the loss of these permanent lawyers by hiring 2 temporary lawyers. The use of temporary lawyers is not the best way to handle this situation inasmuch as if we don't offer them a fixed term assignment in the near future, they may seek employment elsewhere. We have already invested one week of training time in them by sending them to the California District Attorneys Association beginning level course for new lawyers. We will be investing additional time in training them to handle misdemeanor matters in one of our branch offices. If these attorneys decide to remain in our employment as temporary lawyers after their eligibility on the Deputy District Attorney - Fixed Term employment list expires, they would be required to take the examination again and reestablish their eligibility. This could pose a problem for them and our office because we normally go down the employment list when we interview for temporary employment. One of the inducements for lawyers to come to work for us as a temporary is our assurance that they will be the next persons to get a fixed term employment in our office. If they were not successful in the new examination in getting their name near the top of the list, we could encounter problems if we had to bypass minority candidates to reach them. The best solution we see to avoid these problems is to cancel .two permanent lawyer positions and create two fixed term positions in their place. We want to ' do this with an understanding from your office that we be permitted to move positions from the permanent to the fixed term level back to the permanent level as our personnel situation dictates: We agree to submit appropriate P300 documentation to effectuate, these changes and they will be accomplished within our budget limits. It is our intention to convert two Deputy District Attorney - Fixed Term II positions to permanent Deputy District Attorney Basic Salary Assignment once the incumbents in these positions gain eligibility on the promotion list. Accordingly, approval of your office is requested for the P300 being submitted to cancel Deputy District Attorney positions #068 and #194 and add two Deputy District Attorney - Fixed Term positions in their place. In support of this request, attached for your review and information is an October 15, 1984 current fiscal year budget statement from Pat Godley to Mark Finucane indicating the two proposed occupational health specialist positions for the Environmental Health Division with previously projected hire dates of November 1, 1984 and December 1, 1984 respectively. The funds necessary for coverage of the two additional positions are currently in place within the Environmental Health Division's fiscal year 84/85 budget. These Ironies are pri- marily the result of revenues projected for Occupational Health/Hazardous Materials program services, and to some extent, salary savings. With respect to funding for the proposed two new positions in subsequent fiscal years, the entire cost of these two positions will be borne by program fees for service from the following users: 1) Interdepartmental charges for services to Personnel Department Safety and Benefits Program and Public Works Safety and Benefits Program. 2) Direct revenue sources for inspection of hazardous waste generators throughout Contra Costa County, estimated user base approximately 600, pro- jetting approximately $66,000 annually. 3) Direct revenue sources from fees for service for implementing the State man- dated inspection of underground storage of hazardous materials, (estimated number of facilities is 2,000) with an estimated revenue recovery of at least $150,000 annually. 3 81 A-41 / The programmatic demands for occupational health, industrial hygiene, hazardous waste management and hazardous materials response services require immediate approval, recruitment, and hiring of these two requested occupational health specialist positions. The Environmental Health Division's_occupational Health/Hazardous Materials Unit's current program services include: 1) Emergency response countywide. 2) Hazardous waste generators inspection program countywide. 3) Current implementation of inspection of underground storage of hazardous materials countywide. 4) Facilitation of site characterization, mitigation, and cleanup of all State of California Superfund hazardous waste sites identified within Contra Costa County. 5) Provision of requested services for County Personnel Department Safety and Benefits. 6) Continuation of asbestos evaluation and correction program. 7) Inspection of hazardous waste haulers headquartered in Contra Costa County, pursuant to State Memorandum of Agreement. 8) Implementation of data base system and the computerization of data con- cerning hazardous waste treatment, storage, and generation and disposal in Contra Costa County. 9) Delivery of services requested by Contra Costa County governmental agencies currently include: a) City of Concord - Air quality and chemical inventory for police depart- ment lab. b) City of Pleasant Hill - Air quality in police department. c) John Swett Unified School District - Ventilation studies. d) County Health Services Department 1) Ventilation on E Ward 2) Ongoing chemical evaluation for organic hydrocarbons, anesthesia gases, sterilants, (ethyline oxide) , and mercury vapors for dental clinics and Medical Services. 3) Educational program conducted at Los Medanos College for the training of emergency response personnel from other public agencies throughout the county. 10) Radiological health monitoring countywide. 11) Investigation of health related or environmentally related concerns countywide with respect to any hazardous materials/waste including: Board directed inquiries for investigations, i.e., herbicides monitoring in the delta waters; well water contamination; epidemiological investigations regarding hazardous waste disposal sites, including staff support to the Board of Supervisors Hazardous Materials Task Force. 12) Community noise monitoring, upon request. Current occupational health/hazardous materials staff assignments are priori- tized to .provide the following program services, in conjunction with the Division Director: Godfrey Becks - Senior Ocupational Health Specialist a) Emergency response - 24 hours a day, 7 days a week availability. There have been in excess of 300 emergency response requests through the first three quarters of 1984. In my professional opinion, a minimum of two staff persons should respond to emergency hazardous materials/waste releases with sufficient technical expertise to provide reciprocal backup at the scene. This capability does not currently exist within the existing staff levels. I would intend to hire both positions from a list of can- didates with appropriate technical skills to meet this program need. 1�l 1 1 b) Facilitator for Superfund hazardous waste disposal site activities. c) Occupational health hazardous materials/waste monitoring. d) Investigation of community complaints, and epidemiological and environmental investigations pursuant to Board request. e) Educational training for emergency response personnel. Bruce Benike - Senior Occupational Health Specialist Primary responsibility for three regulatory programs: a) Implementation of the hazardous waste generators inspection program. b) Development and implementation of the underground hazardous materials storage enforcement program. c) Radiological health services, as required. I have camLitted two occupational health specialists (Gabriel Adebiyi and Jim Obermiller) to servicing the on site inspection of hazardous waste genera- tors and inspection of underground hazardous materials storage facilities. It is essential to maintain a responsible level of service in these programs con- sidering the preventative aspects of actual site inspections. These two programs are Board mandated and State mandated. The County has assumed a direct regulatory responsibility for inspection of hazardous waste generators by com- mitting to a Memorandum of Agreement with the State Department of Health Services, pursuant to Board resolution. Mary Lewis - Senior Occupational Health Specialist Mary Lewis is currently working part time (approximately 18 hours per week) as a consequence of prior maternity consideration. Mary's expressed intent is not to return to full time employment with Contra Costa County. Her current respon- sibilities include staff support for the Board of Supervisors Hazardous Materials Task Force and additional projects as directed, e.g, evaluation of pro- posed Dow Chemical incinerator unit, and other issues of acute community concern. l � l Kirby Narcisse - Prior Interagency Personnel Agreement With EPA On loan, pursuant to an IAP agreement with EPA to the Environmental Health Division of Contra Costa County through 1/2/85. ' Prior program responsibility was implementation of the asbestos identification and evaluation program within the County owned and other governmental facilities in Contra Costa County. Kirby has accepted a full time staff position beginning 1/7/85 with Contra Costa County Personnel Department Safety and Benefits program. The Director of Occupational Health/Hazarous Materials program is currently vacant. Direct operational responsibilities for these program services has been assumed, since September, 1983, by the Division Director. The current program responsibilities that are not being appropriately staffed considering the aforementioned commitments of existing available staff time include: 1) a) Professional depth for emergency response countywide. b) Inability to operationalize the second high-tech emergency response vehicle currently acquired from State DOHS which requires additional staffing capability. 2) Servicing professional requests from Safety and Benefits in a timely manner, i.e. complete countywide chemical inventory, prospective implemen- tation of asbestos identification and correction program in county owned and operated facilities. 3) Requests for evaluation of alleged employee exposures. 4) No current inspection of hazardous waste haulers. 5) Inability to respond within expected time frames to Board inquiries and industrial hygiene service requests from other governmental and institu- tional agencies. 6) Inability to cotmit sufficient staff time to conduct in depth epidemiologi- cal investigations relative to hazardous waste disposal sites, etc. 1 L 7) Inability currently to ccnmit professional staff time to input accumulating hazardous waste program data base into a computerized system to permit rapid and meaningful data recovery, and to conduct community risk analysis. 8) Insufficient staff time to provide ccenprehensive training. This deficiency minimizes ability to provide technical staff backup and cross program staff expertise and availability within existing personnel. I respectfully request that your office pursue approval and agenda for the Board of Supervisors consideration these two requested occupational health specialist positions immediately. In addition, I respectfully request that you seek the necessary approval for authorization to hire, on a temporary or interim basis, ane of these two staff positions immediately. I would intend to ccecmit the professional staff time of this individual to delivering the requested Safety and Benefits Program ser- vices. It is essential, especially in view of the loss of Kirby Narcisse's ser- vice, that we provide a deliverable commitment to Safety and Benefits for their program needs. There are several prospective candidates who have stated an interest in pursuing a competitive examination for professional positions within our Occupational Health/Hazardous Materials program, who are located in Contra Costa County. It is likely that one of these prospective candidates would be immediately available to pursue full time employment on an interim basis and acct modate immediate program needs. BACKGROUND The Health Services Department, Environmental Health Division, is requesting the addition of two (2) Occupational Health Specialist positions in order to carry out the program for inspection of hazardous waste generators throughout this County and for implementation of the State mandated inspection of underground storage of hazardous materials . On July 6 , 1984 the Board of Supervisors adopted a fee ordinance for the inspection of the inspection of the hazardous waste generators. It is anticipated that an ordinance and fee structure for inspection of underground storage of hazardous materials will be placed on the Board of Supervisors ' agenda within the near future. The two full time Ocupational Health Specialist positions are required in order to fulfill the Environmental Health Division' s program mandates. The cost of both positions will be offset by revenues generated from th.e inspection fees of both. the hazardous waste generators andunderground hazardous materials storage- facilities. In addition, the cost for these. positions will be offset by interdepartmental charges for services provided by the Environmental Health. Division, of the..Health Services Department to such county departments as Personnel and Public Works. IMPACT OF NOT APPROVING THIS ACTION If these two positions are not approved, the impact would not only be felt by the Health Services Department, Environmental Health Division, but other county departments as well. For example, the Personnel Department, Safety and Benefits Division, and the Public Works Department, Safety and Benefits Division, have requested specific inspection and monitoring services from the Environmental Health Division. These services cannot be provided at the present division's staffing level. If these two additional positions are not approved, then both the Public Works Department and the Personnel Department would be required to contract at a higher cost for these inspection and monitoring services.
