RECOMMENDATION(S): (CONT'D)
and ACCEPT the Grant Deed from Samantha J. Waldie for 10 Drake Street, Antioch, Assessor’s Parcel No.
067-283-016.
AUTHORIZE the Public Works Director, or designee, to execute said Right of Way Contract and Rental Agreement
on behalf of Contra Costa County (County).
APPROVE payment of $142,200.00 for said property rights payable by the Contra Costa Transportation Authority
(CCTA) to North American Title Company, through wire instructions to: Comerica Bank Escrow Account, 2321
Rosecrans Ave., Ste. 5000, El Segundo, CA 90245; Federal Routing No. 121137522; Credit Account No.
1893547057; County and Branch No.: 54705; Attention: Cathy Coghlan, phone (925) 838-4899 for Escrow No.
827209.
AUTHORIZE the Auditor-Controller to issue a check in the amount of $1,100 per month in accordance with the
terms and conditions of the Rental Agreement payable to Samantha J. Waldie, 732 Summerset Drive, Rio Vista, CA
94571.
DIRECT the Real Property Division to have the above referenced Rental Agreement delivered to Samantha J. Waldie
and ensure the Grant Deed is delivered to the Title Company for recording in the Office of the County Recorder.
FISCAL IMPACT:
There is no impact to the County General Fund. These activities are funded by Contra Costa Transportation Authority
(100%) (ACQ/3540).
BACKGROUND:
These property rights are required for the State Route 4 (E) Widening – Somersville Rd. to Route 160 Project in
accordance with the approved plans and specifications. The County is currently in escrow with the property owner for
the purchase of her land and improvements. Since the County cannot prevent the owner from renting the residence
before the County has acquired the property for the project; the County wishes to enter into a rental agreement with
the property owner to minimize relocation costs that may occur for future occupants.
CONSEQUENCE OF NEGATIVE ACTION:
The project will not have sufficient land rights to allow construction in accordance with the approved plans and
specifications.
The County could be liable for additional relocation expenses if the property is rented to other tenants.
