APPROVE a Lease Termination Agreement with Enea Square Partners, L.P. to terminate the lease at 1470 Enea Circle, Suite 1500, Concord, effective October 20, 2009, for approximately 7,915 square feet of office space for the Employment and Human Services Department under the terms and conditions set forth in the Agreement. 2. AUTHORIZE the Director of General Services, or designee, to EXECUTE the Agreement. 3. DETERMINE the project is a Class 1(a) Section 15061(b)(3) Categorical Exemption under the California Environmental Quality Act (CEQA) CP#09-72. 4. DIRECT the Department of Conservation and Development Director, or designee, to file a Notice of Exemption with the County Clerk, and DIRECT the Director of General Services, or designee, to arrange for the payment of the handling fees to the Department of Conservation and Development and County Clerk for filing of the Notice of Exemption. Lango, General Services Director Date:October 20, 2009 Contra Costa County Subject:Approve a LeaseTermination Agreement for 1470 Enea Circle, Suite 1500, Concord FISCAL IMPACT: The County has a lease for the premises that runs through December 31, 2009. The lease obligates the County to pay total rent of $51,060 for the remainder of the term. By terminating the lease early, the County will not have to pay rent of $13,060 it would otherwise have to pay. BACKGROUND: The Employment and Human Services Department (EHSD) has occupied the premises at 1470 Enea Circle, Suite 1500, in Concord since February 2001. EHSD vacated the premises in September 2008, when it relocated its staff to Ellinwood Way in Pleasant Hill. The lease is set to expire on December 31, 2009. The landlord of the premises has found another tenant to occupy the premises, and is willing to let the County out of its lease early. The County will not pay rent for the period when the new tenant occupies the premises. CONSEQUENCE OF NEGATIVE ACTION: If the Lease Termination Agreement is not approved, the Employment and Human Services Department will not terminate the lease early, and will not realize the savings of $13,060 as noted above.
