ACCEPT the Right of Entry Agreement from the Contra Costa Water District (District) and AUTHORIZE the Public
Works Director, or designee, to execute said Right of Entry Agreement on behalf of the County.
FISCAL IMPACT:
There is no impact to the County General Fund. This project is funded 56% American Recovery and Investment Act
and 44% Proposition 1B.
BACKGROUND:
In preparation for construction of the Vasco Road Safety Improvement project, the Public Works Department
(Department) has been negotiating with the District for temporary property rights for the construction of a staging
area. The construction staging area is located on District property adjacent Vasco Road. These property rights are
required for the project in accordance with the approved plans and specifications. Construction is scheduled to begin
in Spring 2010.
In order to proceed with the project, the District and the Department have agreed to enter into a Right of Entry
Agreement. The Department and the District will continue to negotiate and will enter into a

Temporary Easement.
As a condition of the Right of Entry Agreement, the District has required the County to indemnify the District.
CONSEQUENCE OF NEGATIVE ACTION:
The project will not have sufficient land rights to allow construction in accordance with the approved plans and
specifications.
