NOES: None. ABSENT: None . ABSTAIN: None. SUBJECT: Determination of Property Tax Exchange Cunha Subdivison 5313 Annexation to Oakley Water District RESOLUTION NO. 85/81 (LAFC 85-2) WHEREAS, Section 99. 1 of the Revenue and Taxation Code provides that a jurisdictional change resulting from a special district providing one or more services to an area where such services have not previously been provided shall not become effective if one or more affected special districts involved in the property tax exchange negotiation fails to adopt a resolution agreeing to a transfer; and WHEREAS, the Board of Supervisors shall determine the property tax exchange for each affected district that fails to adopt a resolution agreeing to a property tax transfer, except for the annexing district; and WHEREAS, the Oakley Water District is the only affected agency in the Cunha Subdivision 5313 annexation to Oakley Water District and the District has requested that no property tax be exchanged as a result of the annexation; NOW, THEREFORE, BE IT RESOLVED THAT THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY HEREBY DETERMINES that no property tax will be transferred to the Oakley Water District as a result of annexing the territory described in the Cunha Subdivision 5313 annexation to Oakley Water District (LAFC 85-2 ) . This resolution does not change the property tax revenues accruing to other agencies serving the subject territory or the affected districts ' right to collect taxes for existing bonded indebtedness. The property tax exchange agreement discussed above shall apply to affected territory as submitted or revised by the Local Agency Formation Commission. hereby certify that this is a true and correct copy of an action taken and entered on the minutes of the Board of Supervfs yohe date shown. SUBJECT: Determination of Property Tax) Exchange for Canyon Lake ) Boundary Reorganization ) Resolution No. 85/ 82 (LAFC 84-40-J) ) WHEREAS, Section 99. 1 of the Revenue and Taxation Code provides that a jurisdictional change resulting from a special district providing one or more services to an area where such services have not previously been provided shall not become effective if one or more affected special districts involved in the property tax exchange negotiation fails to adopt a resolution agreeing to a transfer; and WHEREAS, the Board of Supervisors shall determine the property tax exchange for each affected district that fails to adopt a resolution agreeing to a property tax transfer, except for the annexing district; and WHEREAS, the Canyon Lakes 90-J Boundary Reorganization (LAFC 84-40-J) involves annexation of territory to Central Contra Costa Sanitary District for which property tax exchange is determined by the previously approved master property tax exchange agreement; and WHEREAS, the reorganization proposes concurrent annexation of territory to County Service Area R-7 (CSA R-7 ) and County Service Area L-42A CSA L-42 ) and no resolutions have been adopted agreeing to property tax exchanges regarding the County Service Areas involved in the subject reorganization; and WHEREAS, for the property tax allocation to be made under this resolution, the Auditor-Controller of Contra Costa County shall first apply,-.the provisions of the master property tax agreement between the Central Contra Costa Sanitary District and the County and then apply the tax increment allocation factors for property -tax increment apportionment to CSA R-7 as shown on the attached schedules marked Exhibits A-1, A-2 and A-3; THEREFORE, BE IT BY THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY RESOLVED that the property tax increment allocation factors for the affected agencies in the area of the Canyon Lakes 90-J Boundary Reorganization (LAFC 84-40-J) shall be as shown on the attached schedules (Exhibits A-1, A-2 and A-3 ) for the fiscal year for which the State Board of Equalization makes the tax rate area changes for this jurisdictional change. Said factors shall apply in subsequent years unless changed by the mutual agreement of affected agencies or subsequent jurisdictional changes. Said increment tax allocation factors apply to affected territory as submitted or revised by the Local Agency Formation Commission. This resolution does not change the affected districts ' right to collect taxes for existing bonded indebtedness.
