Closed Session Agenda: A. CONFERENCE WITH LABOR NEGOTIATORS 1. Agency Negotiators: Ted Cwiek and Keith Fleming. Employee Organizations: Contra Costa County Employees’ Assn., Local No. 1; Am. Fed., State, County, & Mun. Empl., Locals 512 and 2700; Calif. Nurses Assn.; Service Empl. Int’l Union, Local1021; District Attorney’s Investigators Assn.; Deputy Sheriffs Assn.; United Prof. Firefighters, Local 1230; Physicians’ & Dentists’ Org. of Contra Costa; Western Council of Engineers; United Chief Officers Assn.; Service Empl. Int’l Union United Health Care Workers West; East County Firefighters’ Assn.; Contra Costa County Defenders Assn.; Probation Peace Officers Assn. of Contra Costa County; Contra Costa County Deputy District Attorneys’ Assn.; and Prof. & Tech. Unrepresented Employees: All unrepresented agency management employees (Resolutions Nos. 2009/341, 2009/342 and 2009/343, including their respective exhibits), and all other unrepresented agency employees. Deliberation Items D.1 ACCEPT report on Delta-Water legislative bills and consider adopting positions; CONSIDER oral report on mitigation measures for Delta Counties; and CONSIDER providing direction to staff on a response to any Delta-related issues. (Supervisor Piepho) Supervisor Piepho introduced the item, noting that while planning is going on at the state level the Delta Counties need to advocate to prevent harm to the Delta, and to also make sure that if by chance there should be any negative impacts from proposed actions that there are plans in place for mitigation. Supervisor Piepho noted impending actions of the State Joint Conference that could bring a final report by this Friday and asked the Board for direction. Supervisor Piepho also stated the five Delta Counties wrote an opinion-editorial piece that was published in the Sacramento Bee today and the Supervisor said there was also an editorial published in the Contra Costa Times on the Sunday prior.Supervisor Piepho introduced Roberta Goulart of the County Water Agency to provide further comment. Ms. Goulart stated today is the culmination of what the Board has done with the creation of its platform and its coalition with the five Delta Counties. Ms. Goulart said we are now waiting until 5:00pm today to see the five Delta- related bills that could go to legislation and noted that financial components will not be included in the legislation proposed today. Ms. Goulart stated she has low confidence that the Board will want to support the legislative package as it stands. She suggested the Board reaffirm its commitment to work with the five Delta counties as working together is their key to being heard. Supervisor Glover stated it is important for the Board to give authority to Supervisor Piepho to allow her to take the initiative in representing the principles of this Board at the State level. Supervisor Uilkema asked if other Delta counties have taken positions on the peripheral canal and stated that it might be an issue that could fragment the coalition. Ms. Goulart responded that the canal is not the issue yet.
