Sec. 913-6.024, ' Protest, Establishing Area of ) 913-E.026) Benefit, and Establishing ) Estimated Costs, Cost Allocation, ) Fee Apportionment,, Oakley area ) The Board of Supervisors of Contra Costa County FINDS that: Government Code Section 66484 and Division 913, Title 9, of the Contra Costa County Code provide for assessing and collecting fees for bridge and/or major thoroughfare construction within a designated area of benefit as a condition of approval of a final subdivision map or as a condition of issuing a building permit; and The Public Works Director and the Director of Planning have completed a development program report for the Area of Benefit which was filed with the Clerk of the Board on December 31 , 1984, and notice of the proposed hearing was duly given in accordance with Section 913-6.014 of the Contra Costa County Code; and After taking public testimony, Supervisor Torlakson stressed that the area of benefit should be considered an interim tool and not necessarily the permanent solution and definitely not the total solution in addressing Oakley's infrastruc- ture. Supervisor Torlakson having recommended that: a. The following recommendations dated February 11 , 1985, of the Director of Public Works be adopted and included in the revised Development Program Report: i. Accept the revised Development Program Report dated February 6, 1985. ii , Direct the Public Works and Planning Directors to closely co-ordinate the Oakley General Plan Review so that land use and transportation planning are integrated. iii . Direct the Public Works Director to review and update the Develop- ment Program Report for the Oakley Area of Benefit at such time as the Oakley General Plan is updated, iv. Establish an advisory committee that would make recommendations to the Board of Supervisors on road improvement priorities in Oakley; and b. Language on payment schedule be modified to read, fees will be collected at the time of filing of final subdivision map or on call as needed for an actual construction project"; and C. Public Works Department be requested to meet with the City of Brentwood and Bethel Island Specific Plan Committee regarding fee areas on sub-districts to pay for improvements identified in the greater Oakley area; and l • d. The Development Program Report and the recommended fee be adopted on interim basis and be reviewed in March 1985 by the Planning, Transpor- tation, Housing and Development Committee; and e. The Planning, Transportation, Housing and Development Committee be directed to provide a progress report on how the Ralph Anderson Study is proceeding; and f. The Development Program Report be referred to the Ralph Anderson Study Advisory Committee for a comprehensive approach to the Oakley area planning, transportation and development problems. A Negative Declaration pertaining to this project was published with no protests received during the review period and the Board hereby CONCURS in the findings that the project will not have a significant effect on the environment and hereby DIRECTS the Public Works Director to file a Notice of Determination with the County Clerk; and This Board hereby DETERMINES that a majority protest does not exist, inasmuch as a written protest has not been filed by the owners of more than one-half of the area of the property to be benefited by the improvement; and This Board hereby ADOPTS the revised development program report with amend- ments dated February 6, 1985, pertaining to the Oakley Area of Benefit, its boundaries , estimated cost of improvements, cost allocation, and method of fee apportionment and the fees set at as residential $1,315 per dwelling unit, commercial $1 .55 per square foot of gross floor area and industrial $4,535 per gross acre or 35 cents per square foot of developed floor area. NOW, THEREFORE, IT IS HEREBY RESOLVED that an area of benefit is hereby ESTABLISHED in the unincorporated area of the County of Contra 'Costa pursuant to Section 913-6.024 of the Contra Costa County Ordinance Code, the boundaries of which are described in the development program_ report pertaining to the Oakley Area of Benefit and the Clerk of this Board is DIRECTED to file a certified copy of this Resolution with the County Recorder as specified in Section 913-E.026 of the Contra Costa County Ordinance Code. IT IS FURTHER RESOLVED that the above recommendations of Supervisor Tor•lakson are approved.
