HomeMy WebLinkAboutMINUTES - 11032009 - C.40RECOMMENDATION(S): Approve and authorize the Health Services Director, or his designee (Patricia Tanquary), to execute, on behalf of the County, Agreement #27-789 with Rite Aid Corporation, in an amount not to exceed $100,000 for dispensing Influenza Virus H1N1 antiviral medications to Contra Costa County residents, for the period October 1, 2009 through September 30, 2010. FISCAL IMPACT: 100% by State Funds. No County match required. BACKGROUND: On April 26, 2009, the United States Secretary of Health and Human Services declared a National Public Health Emergency due to the risk of an Influenza Virus H1N1 (Swine Flu) outbreak. The Influenza Virus H1N1 is a contagious disease. The County Health Officer for Contra Costa Health Services Department has the authority under the Contra Costa County Charter and Codes to control and prevent the spread of any dangerous contagious or infectious diseases that may occur within his or her jurisdiction. Contra Costa County is in receipt of the antiviral medications to address Influenza Virus H1N1. It has become necessary to disburse antiviral medications to entities in Contra Costa County and to dispense, as needed, for infected or exposed persons. In conjunction with the County’s Public Health Department, Rite Aid Corporation pharmacy locations possess the appropriate State licensure to dispense medications. This Agreement includes mutual indemnification for any and all claims, or losses resulting from negligent act or willful misconduct of County or Rite Aid Corporation. Approval of Agreement #27-789 will allow Contractor to dispense H1N1 antiviral medication as request for treatment or prophylaxis of exposed persons using protocols approved by County’s Health Officer, through September 30, 2010.
