SUBJECT: Legislation: Senate Bill 221
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
Adopt a position in support of SB 221 by Senator Boatwright which would require with-
holding the names and addresses of victims of specified sex crimes unless the victim
authorizes the release of his or her name or address.
BACKGROUND:
Current law (Government Code Section 6254) details specified types of information that
are not required to be disclosed publicly and includes certain exceptions to those
rules. One of the exceptions requires that law enforcement agencies make public the
name, age, and current address of victims of crimes. However, in the case of certain
specified sex crimes, the law enforcement agency is prohibited from releasing the
address of the victim, but must still release the name and age of the victim. Because
of the nature of these crimes, and the fact that many of the victims are minors, or
women, the mandatory release of the victim's name and age can tend to embarrass the
victim and make them less likely to report a crime knowing that their identity must be
made public.
At the request of the Board of Supervisors, Senator Boatwright has introduced SB 221
which would amend Government Code Section 6254 to prohibit release of the name or
address of the victim of specified crimes unless that disclosure is authorized by the
victim. This bill was suggested by the Sheriff-Coroner and as a part of the Board's
legislative package should be specifically endorsed by the Board.
