APPROVE Notice of Intention to Convey Real Property attached hereto to Crockett
Community Services District (District) in accordance with the terms and conditions of the
Real Property Conveyance Agreement on file in the Public Works Department; said
property is not required for Contra Costa County (County) present and future use pursuant
to Government Code Section 25365.
FIND that this activity will not have a significant effect on the environment, and that it has
been determined to be exempt from the California Environmental Quality Act (CEQA)
under State CEQA guidelines Article 5, Section 15061 (b)(3). This Board DIRECTS the
Director of the Department of Conservation and Development (DCD) to file a Notice of
Exemption with the County Clerk, and AUTHORIZE the Public Works Director, or
designee, to arrange for payment of the $50 fee to the County Clerk for filing and a $25 fee
to the DCD for processing of the Notice of Exemption. (CP No. 09-58)
DECLARE that this Board will meet on October 20, 2009 at 9:30 a.m. or thereafter, in the
Board’s Chambers, County Administration Building, Martinez, California, to consummate
the conveyance.

of the Board to publish the attached notice in the Contra Costa Times pursuant to
Government Code Section 6061.
FISCAL IMPACT:
There is no impact to the County General Fund. The County will no longer be
responsible for maintenance and care of the property which will be transferred to the
District
BACKGROUND:
California and Hawaiian Sugar Refining Corporation (C&H Sugar) granted to the County
on July 24, 1924, the property known as Assessor Parcel Number 354-041-020, located at
the northeast corner of the intersection of Pomona Street and Alexander Avenue in
Crockett for the specific purpose of constructing a building, memorial hall or meeting
place for Associates of Veterans. If that use was to be discontinued, then the property was
to be used for other public uses as school purposes, Public Park, children’s playground,
community club or Boy Scout activities.
The Veterans of Foreign Wars Post U.S.S. Argonaut Ship No. 1928 (Post) leased the
property from the County until they terminated the lease on November 4, 2008. The Post
sited dwindling membership and advanced age of its membership and their inability to
continue to take care of the property. With the Post terminating its County Lease, the
County has the responsibility for day to day maintenance and care of the property.
Since the Post is no longer using the property, the building has been boarded up and on
Memorial Day 2009, the District held an open house for the community to view the
property, building and to comment on potential public uses. The community sentiment
was unanimous to rescue the property and building from its current state of disrepair and
use it as a museum and public meeting place. With the community backing them, the
District would like to take over the ownership and maintenance of the property from the
County.
The District does not have the funds to acquire the property from the County, but has
agreed to pay for staff time involved in transferring title to them. The District is in a better
position than the County along with being more focused on taking care of the property
and operating the facility for public purposes which was the original intent of C&H
Sugar.
CONSEQUENCE OF NEGATIVE ACTION:
If the County did not transfer title to the property they would continue to be responsible
for the maintenance and care of the property and building. Also the property may revert
back to C&H Sugar because it would no longer be used for public purposes under the
terms and conditions of the deed recorded in Book 478 of Deeds at Page 37 Official
Records of Contra Costa County.
