HomeMy WebLinkAboutMINUTES - 09152009 - C.92RECOMMENDATION(S): DETERMINE that the Contra Costa County Redevelopment Agency has initiated activity associated with the development of property acquired by the Agency using Low and Moderate Income Housing Funds, including certain real property located in the Orbisonia Heights area, Bay Point; 190 Bel Air Lane, Bay Point; 195-199 North Broadway, Bay Point; 96 Enes Ave., Bay Point; 1250 Las Juntas Way, Walnut Creek; and 720 Willow Way, Rodeo FISCAL IMPACT: No impact to the General Fund. BACKGROUND: California Redevelopment Law (Health and Safety Code Section 33334.16) requires that a Redevelopment Agency acquiring properties using Low and Moderate Income Housing Funds initiate activities related to development within five years from the date it first acquires the property. If the activities have not been initiated, the legislative body may extend the period during which the Agency may retain the property for one additional period not to exceed five years. The County Redevelopment Agency has acquired properties subject to this requirement that are approaching the end of their initial five-year period. These properties are 1) various properties within the Orbisonia Heights area of Bay Point; 2) 190 Bel Air Lane, Bay Point; 3) 195-199 North Broadway, Bay Point; 4) 96 Enes Ave., Bay Point; 5) 1250 Las Juntas Way, Walnut Creek (Contra Costa Centre Redevelopment Project); and 6) 720 Willow Way, Rodeo. Activities related to development have been initiated therefore staff is recommending that the Board of Supervisors take an affirmative action recognizing these development activities, and determining compliance with the Health and Safety Code requirement.: • Orbasonia Heights, Bay Point Since acquiring the County has adopted a Specific Plan for the area that includes the various properties (June, 2002), and has rezoned the property as part of an area wide P-1 Rezoning (February, 2006). The Agency is actively seeking to complete the assemblage of the Orbisonia Heights area for a future transit-oriented development site that will include low & moderate income housing. The Agency secured a Master Developer, but terminated that relationship as the housing market softened and the inability of the developer to acquire sites became apparent. The Agency has acquired approximately 85% of the sites, and expects to complete property assemblage in FY 10. • 190 Bel Air Lane, Bay Point The Agency acquired the property to provide a site for relocating a special needs housing facility from the Orbasonia Heights area. Staff is negotiating terms of a Disposition and Development Agreement with Youth Homes at this time. An Agreement is expected to be considered by the Agency prior to the end of 2009. • 195-199 North Broadway, Bay Point The subject properties were acquired as part of the larger North Broadway revitalization program, which has already resulted in the development of new affordable rental housing (Bella Monte Apartments, 52-units) and for-sale housing (Nantucket Cove, 69-units). These peripheral sites are to be made available for development in the next 2-3 years as housing market conditions improve. • 96 Enes Ave., Bay Point This single-family home was an affordable unit with deed restrictions from previous Agency assistance. The Agency purchased the property to retain its affordability, renovated the home, and is renting the property until the for-sale market improves. • 1250 Las Juntas Way, Walnut Creek/Contra Costa Centre Since acquiring this property in the City of Walnut Creek the Agency has designated a Master Developer and entered into negotiations related to an Exclusive Negotiating Rights Agreement. Those negotiations failed to result in an agreement as for-sale housing market conditions deteriorated. A second attempt at negotiating an Agreement failed to yield results in the current housing market. Staff agreements were reached with the City of Walnut Creek regarding the development of a 28-unit project with seven very-low and moderate income units. Once the housing market stabilizes the Agency will seek a Master Developer for the site. • 720 Willow Way, Rodeo A portion of the acquired property has been developed with 52 units of affordable senior housing. The remainder of the property is being held for a subsequent phase, or for a complementary use for the area. In 2005 the Board of Supervisors adopted the Rodeo Redevelopment Area Planned Unite Development Zoning Code and Design Guidelines (P-1) for the purpose of establishing a zoning code that promotes Rodeo’s unique character. It is anticipated that this property will be utilized for an activity complementary to the existing senior housing next door.
