HomeMy WebLinkAboutMINUTES - 09152009 - C.5RECOMMENDATION(S): APPROVE and AUTHORIZE the Public Works Director, or designee, to execute a Cooperative Agreement containing modified indemnification language, effective September 15, 2009, between Contra Costa County and East Bay Regional Park District for the county to provide funding up to $25,000 for the engineering study of the Great California Delta Trail project, Bay Point and Clyde areas. FISCAL IMPACT: No fiscal impact to the general fund. Adoption of the Agreement will provide funding up to $25,000 to the East Bay Regional Parks District for the engineering study of the Great California Delta Trail project. Funds will come from the Navy Mitigation Fund per the Expenditure Plan previously adopted and recommended by Supervisors Glover and Bonilla on June 17, 2008. BACKGROUND: On June 17, 2008 the Board of Supervisors approved the Navy Mitigation Expenditure Plan (attached). BACKGROUND: (CONT'D) the waterfront access that was lost when Port Chicago Highway was closed. The Great California Delta Trail engineering study is one of the projects listed as trail projects in the Navy Mitigation Expenditure Plan. $350,000 was allocated to the planning and environmental review for the portions of the Great California Delta Trail within Contra Costa County (the overall trail will eventually ring the Delta Region, connecting to the Bay Trail in Martinez). At this time the East Bay Regional Parks District has requested that Contra Costa County allocate part of the money for an Engineering Study of potential trail routes through the East Contra Costa County area. This agreement commits $25,000 of the Navy Mitigation fund to this study consistent with the Navy Mitigation Expenditure Plan approved on June 17, 2008. Public Works worked with County Counsel to draft the modified indemnification language acceptable to both parties. CONSEQUENCE OF NEGATIVE ACTION: Failure to approve this agreement and fund the Great California Delta Trail Engineering Study with Navy Mitigation funds will result in the loss of potential improvements to replace the waterfront access that was lost when the Port Chicago Highway was closed in Contra Costa County and would be inconsistent with the intent of the Navy Mitigation Expenditure Plan adopted on June 17, 2008.
