APPROVE Purchase and Sale Agreement and ACCEPT the Grant Deed dated, July 23, 2009 from Mr. & Mrs. Rhode and Michelle Buenavista for the purchase of 1534 Third Street, North Richmond, identified as Assessor’s Parcel Number 409-080-014. B. AUTHORIZE the Redevelopment Director to execute said Purchase and Sale Agreement on behalf of the Redevelopment Agency. C. APPROVE payment of $470,000 for said property rights and AUTHORIZE the Auditor-Controller to issue a check in said amount payable to Fidelity National Title Company, 3100 Oak Road, Suite 300, Walnut Creek, CA 94597, Escrow No. 253888-DH to be forwarded to the Real Property Division for delivery. D. The Agency has budgeted funds for the recommended acquisition from the North Richmond Redevelopment Program. BACKGROUND: On May 12, 2009, the Governing Board of the Contra Costa County Redevelopment Agency adopted Resolution No. 2009/115 to create a Program of Unified Development for the East Side of 3rd Street between Chesley Avenue and Grove Street. This proposed residential Mixed-Use Project is referred to as Grove Point. This Project is to acquire and redevelop six contiguous parcels fronting Third Street into a mix of commercial and residential amenities. Purchasing 1534 Third Street is the 2nd acquisition under Grove Point’s Unified Development Program. This acquisition and the development of a Unified Development Program has been determined to be exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15061(b)(3) of the CEQA Guidelines. The North Richmond Municipal Advisory Council has reviewed and recommended pursuing acquisition of the Grove Point properties for redevelopment purposes. CONSEQUENCE OF NEGATIVE ACTION: Should the Agency not purchase this site, the North Richmond community will not be able to redevelop Grove Point and complete Phase II of the North Richmond Town Center.
