Approve and authorize the Health Services Director, or his designee (Donna Wigand), to
execute, on behalf of the County, Contract #24–794–8(8) with John Muir Behavioral Health
Center, a non-profit corporation, in an amount not to exceed $100,000, to provide inpatient
psychiatric hospital services for children and adolescents, for the period from July 1, 2009
through June 30, 2010.
FISCAL IMPACT:
This Contract is funded 100% by Mental Health Realignment funds.
BACKGROUND:
Assembly Bill (AB) 757, (Chapter 633, Statutes of 1994), authorized the transfer of state
funding for Fee-For-Service/Medi-Cal (FFS/MC) acute psychiatric inpatient hospital
services from the Department of Health Services to the Department of Mental Health
(DMH). On January 1, 1995, the DMH transferred these funds and the responsibility for
authorization and funding of Medi-Cal acute psychiatric inpatient hospital services to
counties that chose to participate in this

BACKGROUND: (CONT'D)

On August 19, 2008, the Board of Supervisors approved Contract #24–794–8 (7) with John
Muir Behavioral Health Center, for the period from July 1, 2008 through June 30, 2009 for
the provision of inpatient psychiatric hospital services to County-referred children and
adolescents.
John Muir Behavioral Health Center has requested mutual indemnification to hold harmless
both parties for any claims arising out of the performance of this Contract as part of their
standard for approval of the Agreement with the County. In the view of County Risk
Management this mutual indemnification will create a minimal potential loss. The Health
Services Department desires to expedite approval of the Agreement as written.
Approval of Contract #24–794–8 (8) will allow the Contractor to continue to provide
services through June 30, 2010.
