HomeMy WebLinkAboutMINUTES - 08252009 - C.59RECOMMENDATION(S): APPROVE and AUTHORIZE the Department of Conservation and Development Director or designee, to execute a contract with Kentco Construction in an amount not to exceed $259,700.00 for abatement services at Golden Isle, in Old River, Eastern Contra Costa County. FISCAL IMPACT: No General Fund revenues will be used. Costs will be recovered by a special assessment in the form of a tax lien, and by Department funds to the extent that the tax lien does not cover all the costs. BACKGROUND: The Contra Costa County Department of Conservation and Development finds the conditions on the parcel constitute a public nuisance in violation of the following; Residential Property Nuisances Contra Costa County Ordinance 720-2.002 & 720-2.006. All have been constructed without approvals and/or permits. The real property located at Golden Gate Isle, in Old River, Eastern Contra Costa County; APN: 001-111-001 is owned by Golden Gate Water Ski Club. The above-referenced property is located in an A-2 zoning district The county abatement officer made an initial inspection of the above-referenced property on 3/12/2003. The site contains approximately 28 dwelling units (including conventional residences and mobilehomes), a number of related dock facilities and other outbuildings built without approvals or permits. The Notice and Order to Abate was served on the property owners and all known to be in possession of the property by certified mail on 2/23/2005 and posted the above-referenced property on 3/23/2005. The Property owners filed an appeal of Notice and Order to Abate on 3/25/2005. Judgment by THE COURT OF APPEAL OF THE STATE OF CALIFORNIA FIRST APPELLATE DISTRICE DIVISION ONE (Contra Costa County Super. Ct. No N 05-1769) ruled in favor of the abatement on 7/25/2008. Abatement put out to bid on 3/25/2009. Bid from contractor in the amount of $259,700.00 accepted on 5/1/2009.
