HomeMy WebLinkAboutMINUTES - 08252009 - C.58RECOMMENDATION(S): APPROVE and AUTHORIZE the Department of Conservation and Development Director, or designee to execute a contract with Kentco Construction for abatement services at Aquatic Innovation, Inc., island near Quimby Island for an amount not to exceed $119,600.00. FISCAL IMPACT: No General Fund revenues will be used. Costs will be recovered by a special assessment in the form of a tax lien, and by Department funds to the extent that the tax lien does not cover all the costs. Covered boat docks have been constructed at the above mentioned site without approvals or permits, this is in violation of; Adoption of the California Building Code Contra Costa County Ordinance 74-1.002 – Building permits required California Building Code 106.1. The real property is located at an Island near Quimby Island, Knightsen, Eastern Contra Costa County; APN: 023-110-010 is owned by Aquatic Innovations, Inc., 3000 F Danville Blvd., #504, Alamo, CA 94507. The above-referenced property is located in an A-2 zoning district The Notice to Comply was mailed on 7/28/08. The Notice of Intent with a copy of the Notice of Pending Nuisance Abatement Proceeding was served on the property owners on 8/27/2008. The Notice of Pending Nuisance Abatement Proceeding along with the Notice and Order to Abate was served on the property owners and all known to be in possession of the property by certified mail on 1/14/2009 and posted the above referenced property on 1/14/2009. The Property owners did not file an appeal. Abatement put out to bid on 3/25/2009. Bid from contractor in the amount of $119,600.00 accepted on 5/1/2009.
