HomeMy WebLinkAboutMINUTES - 08042009 - C.86-ARECOMMENDATION(S): ADOPT Resolution No. 2009/349 that amends the establishing and governing resolution of the Knightsen Town Advisory Council (KTAC) to be consistent with Board-adopted policies and boundaries for the council. FISCAL IMPACT: No fiscal impact to the County associated with this action. BACKGROUND: On December 16, 2008, the Board of Supervisors adopted policies to improve consistency in the composition, powers, and operation among the County’s Municipal Advisory Councils (MACs), as recommended by the Ad Hoc MAC Committee. Staff was directed to review the Maddy Book, MAC establishing resolutions, MAC Bylaws and other relevant resolutions to make amendments consistent with all Board-approved policies. Along with the adopted policies, the Board of Supervisors on December 16, 2008 also approved the proposed boundary for the Knightsen Municipal (Town) Advisory Council. However, during the public hearing, concern about the Knightsen TAC boundary was expressed by the community. Based on this concern, the Board of Supervisors, at the request of Supervisor Piepho, directed the Department of Conservation and Development (DCD) to work with Supervisor Piepho’s office to conduct community outreach and to return to the Board of Supervisors if there were any suggested changes to the boundary. Supervisor Piepho, her staff, and DCD staff attended several KTAC meetings, presenting draft versions of the KTAC boundary map that are compatible with the Board of Supervisors-adopted MAC policies of December 16, 2008. Through this process, one area was found to meet all criteria and is recommended to be included into the KTAC boundary (see attached map). Additionally, three separate Special Notification Areas were identified to be added (in addition to) to the previously adopted Old River Elementary School Special Notification Area. The new Special Notification Areas include a portion of the BACKGROUND: (CONT'D) Veale Tract (Reclamation District), as requested by the custodians of Veale Tract, and the marinas, Lindquist Landingand Holland Riverside Marina, as requested by the KTAC members. With these amendments, KTAC will be notified to provide input for all four Special Notification Areas. The revised boundary map was presented to KTAC at their May 26, 2009 meeting. Speakers in the audience provided additional comment, and KTAC deliberated on the proposed boundary map. The KTAC passed a motion that recommends approval of the map, but did recognize the sentiment from some members of the Knightsen community to have the boundary remain unchanged from the pre-December 2008 boundary map. The KTAC voted to accept the Knightsen TAC boundary map and recommends to the Board of Supervisors their adoption of the revised Knightsen Town Advisory Council boundary that includes a total of four Special Notification Areas, listed below: • Old River Elementary School (previously adopted) • Veale Tract No. 2065 • Holland Riverside Marina • Lindquist Landing With respect to the matter of the term of the Council's existence, Resolution No. 2006/794 includes a provision for the dissolution of the Council on December 31, 2009. By action of the Board of Supervisors at this time, the sunset provision in the establishing resolution is eliminated in its entirety.
