ADOPT Ordinance No. 2009-23 authorizing the Probation Department to charge a daily fee of $17 for electronic surveillance of minors who are under Probation Department supervision. FISCAL IMPACT: Adoption of this ordinance is expected to result in estimated new annual revenue of $301,563 to recover a portion of the costs of providing electronic surveillance of minors who are under Probation supervision. Although it is improbable that the new fee will fully recover costs of this service, the Electronic Monitoring Program continues to be a cost-effective alternative to more expensive incarceration, and a valuable disposition option to the Superior Court in the adjudication of minors. The new revenue will mitigate the impact of pending state cuts to Probation Department funding. Chatman, County Probation Officer Date:July 21, 2009 Contra Costa County Subject:Cost of Electronic Surveillance of Minors BACKGROUND: Currently, the Probation Department does not collect for the cost of electronic surveillance of minors who are under Probation supervision. The attached ordinance authorizes the Probation Department to charge an electronic monitoring fee of up to $17 per day. The Ordinance authorizes the Probation Department to charge the fee only if the juvenile court orders a minor's relatives, their estates, or the minor's estate to pay the fee. (Welf. & Inst. Code, 903.2(a)). Welfare and Institutions Code section 903.2(b) allows the fee to be charged on a person or estate only if the person or estate has the financial ability to pay. (Welf. & Inst. Code, 903.2(b).). Under the attached ordinance, no person or estate ordered to pay the fee will pay an amount that exceeds the financial ability of that person or estate to pay. The Probation Department has a contract with Behavioral Interventions, Inc. ("BI") for BI to provide electronic monitoring equipment, installation, collection services, and technical support. A portion of the actual costs incurred by the Probation Department to provide this type of Probation supervision will be recovered if this Ordinance is adopted.
