HomeMy WebLinkAboutMINUTES - 07212009 - C.132RECOMMENDATION(S): APPROVE and AUTHORIZE the Redevelopment Director, or designee, to execute the Amendment to the Grant of Easement within the Iron Horse Corridor dated July 5, 1977, and recorded on September 13, 1977, with Contra Costa Water District; and DIRECT the Real Property Division to have the above referenced Amendment to the Grant of Easement recorded in the Office of the County Recorder. FISCAL IMPACT: There is no impact to the County General fund. The easement is relevant to the scheduled construction of the Iron Horse Trail Overcrossing, which is funded with budgeted Redevelopment funds, and committed federal, state, and local grant funds. Project No. 0678-6G5575 BACKGROUND: (CONT'D) easement. In 1984, Contra Costa County Redevelopment Agency (Agency) purchased portions of the Iron Horse Corridor (IHC) from SPTC, which included the District’s easement. The District is replacing a portion of its water main pipeline that is located within its easement area in Parcels 13 and 14 of the IHC, which parcels are in the Contra Costa Centre area. As part of the replacement the District requested to relocate their easement area away from the Kinder Morgan Energy Partner’s high pressures gas line. The Agency agreed to have the District relocate a portion of the easement area to a new location within Parcels 13 and 14 of the IHC with the provision that the District would provide the Agency with a metes and bounds legal description and plat clearly showing the new easement area. The District also agreed to quitclaim to the Agency the portion of the easement area from which they were moving their water main pipeline. The District has now determined and mapped the precise location of their facility and would now like to amend a portion of the legal description and plat to the original Grant of Easement. All other terms and conditions of the original grant of easement will remain in full force and effect. In December of 1984, the Board of Supervisors’ determined that the acquisition of the IHC from SPTC would not have a significant effect on the environment, and that it had reviewed and considered the Initial Study and Negative Declaration together with any comments received during the public review process (all of which are on file with the Board), and approved its adequacy for California Environmental Quality Act purposes.
