FISCAL IMPACT: None - This action will maintain costs to the County at budgeted levels. BACKGROUND: On February 20, 2009, the State of California amended the Welfare and Institutions code section12306.1 to reduce the maximum state participation in negotiated In-Home Supportive Services (IHSS) Individual provider wages from $11.50 per hour to $9.50 per hour. There was no reduction in the $0.60 per hour allowance for benefits. The reduction was to take effect on July 1, 2009. On April 15, 2009 the Contra Costa Board of Supervisors authorized the Employment and Human Services Director to submit to the State of California a rate adjustment request for the In-Home Supportive Services (IHSS) Program. The new rate for Contra Costa County was to be $10.32 per hour with no change in the benefits provided. The SEIU United Healthcare Workers (UHW) West filed a lawsuit with the US District Court for the Northern District of California to prevent the implementation of this wage reduction. On June 26, 2009, the Court issued an injunction enjoining the State and “… those persons in active concert or participation with ….” from implementing the wage reduction. Consequently, Contra Costa County must submit a revised request to the State to reinstate the previously approved hourly wage of $11.50 until such time as the US District Court renders a final decision in this matter.
