THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on December 17, 1985 , by the following vote: AYES : Supervisors Powers, .Schroder, McPeak, Torlakson and Fanden NOES: None ABSENT: None ABSTAIN: None -------------------------------------------------------------------- -------------------------------------------------------------------- SUBJECT: Appeal of Lone Star Framing Company from Board of Appeals Denial of Application for DP 3010-85 for an 84-unit Apartment Complex in the West Pittsburg Area. This being the time for hearing the appeal of Lone Star Framing Company (applicant) and Don and Pat Verley (owners) from Board of Appeals denial of application for Development Plan 3010-85 for an 84-unit apartment complex on 3.5 acres on the north side of Canal Road east of Madison Avenue in the West Pittsburg area; and The Board earlier this day, at the request of Don T. Verley (owner) , indicated its intent to continue this hearing to January 14 , 1986 at 2:30 p.m. Supervisor Powers advised that there were people in the chambers who wished to speak on this matter and who did not want the matter continued, and thereupon moved to rescind the previous motion . declaring intent to continue and to hear from those present who wished to speak. The motion was seconded and carried. The Chairwoman declared the public hearing open and the following persons appeared: Jim Bones, representing the applicant, who advised that there seemed to be a difference of opinion between the applicant and the owner with respect to what should be done with this project, that the owner desires to have the hearing continued and the appli- cant was prepared to request that the plans be referred back to the zoning administrator. Zola Gouig presented a letter from the West Pittsburg Alliance urging denial of the subject appeal. No one else having appeared to speak, the Chairwoman declared the hearing closed. Supervisor Torlakson recommended that the appeal be denied in part because the proposal exceeds the maximum density of the general plan, but that the plans be referred back to the Zoning Administrator for further consideration. IT IS BY THE BOARD ORDERED that the recommendation of Supervisor Torlakson is APPROVED.
