APPROVE a License, commencing July 22, 2009, with the East Bay Municipal Utility District (EBMUD) to access EBMUD's communications vault and tower at Pearl Ridge Reservoir, Monte Cresta Drive, Richmond (APN 419-180-005), by the Department of Information Technology, under the terms and conditions set forth in the License. 2. AUTHORIZE the Director of General Services, or designee, to EXECUTE the License. 3. DETERMINE that the project is a Section 15601 (b)(3) Categorical Exemption under the California Environmental Quality Act (CEQA). CP # 08-86 4. DIRECT the Department of Conservation and Development Director, or designee, to file a Notice of Exemption with the County Clerk, and DIRECT the Director of General Services, or designee, to arrange for the payment of the handling fees to the Department of Conservation and Development and County Clerk for filing the Notice of Exemption. Lango, General Services Director Date:July 21, 2009 Contra Costa County Subject:License with East Bay Municipal Utility District for the Communications Site at Pearl Ridge Reservoir for the Department of Information Technology FISCAL IMPACT: The County currently receives annual revenue of approximately $9,200 from EBMUD for EBMUD's use of the County's communication vaults at both the Kregor Peak and Bald Peak sites. The County has agreed to waive this revenue as consideration for the Pearl Ridge License. BACKGROUND: The License will allow access to EBMUD's communications vault and tower by the County's Department of Information Technology to install and maintain new radio communications equipment, antennas, and microwave dishes that will be an integral part of the East Bay Regional Communications System (EBRCS). CONSEQUENCE OF NEGATIVE ACTION: The County would have to search for another location to install the EBRCS communications equipment with considerable loss of time and additional expense.
