SD. 3 CONSIDER approving modified policy and new public information brochure regarding public access to County records, as recommended by the Internal Operations Committee, and directing the County Administrator's Office to disseminate the new policy and brochure, and to conduct training of staff whose job it is to receive and respond to public information requests. (Supervisor Uilkema) Supervisor Uilkema introduced the item and explained the proposed brochure and records request form are intended to provide a Countywide standardization to make it easier for the public to make records requests. She also noted the Supervisors’ Handbook should also be updated accordingly, and the County Administrator should develop a training program for County staff. She added that today’s actions are to be taken with the understanding that this is still a work in progress and if changes are necessary the materials can be revised. Supervisor Piepho said the chain of command in department responses to records requests is critical and asked if the regular involvement of department heads and/or County Counsel should be standardized. Julie Enea, County Administrator’s Office, responded that because County departments are all so different each department really has to develop its own chain of command and system of responsibility. Supervisor Piepho asked if this new information is available online. Ms. Enea responded that once approved by the Board, the policy, informational brochure, 3 of 27 and records request form will all be added to the County’s website. Supervisors Piepho and Gioia made several suggestions for minor word and typographical changes. Chair Bonilla said that we can have all the policies in the world but without the will of the organization they will not be successful. She said County employees need to be as helpful to the public as they can be and should be aware that providing public records is part of their jobs and not an imposition. (Wendel Brunner, Public Health Officer) The following people spoke in favor of the proposed ordinance: Paul (___), co-chair of the Tobacco Prevention Committee and representing the Building Trades Counsel; and Serena Liem of the American Lung Association. Supervisor Glover said it is important to include the consideration of youth in the proposed actions. Supervisor Gioia added that youth can be valuable advocates. HEARING on County Planning Commission recommendation for a County-initiated proposal relating to boat and recreational vehicle storage, including amending the County Ordinance Code to establish the Boat Storage Combining District and a rezoning proposal to apply the new Boat Storage Combining District to lands zoned for agricultural use in the vicinity of Discovery Bay. (100% Conservation and Development funds/unfunded mandate) (Patrick Roche, Conservation and Development Department) Patrick Roche, Department of Conservation and Development-Advanced Planning (DCD), and Catherine Kutsuris, DCD Director, presented the staff report and recommended the following modifications to the ordinance: Ordinance 2009-12, Page 4, Item (d) 6, striking the words “construction drawing” and “engineered calculations”, and remove phrase “in a form satisfactory to the County building official” And, to allow provisions within the permit application process for off-hour access to boat 7 of 27 and vehicle storage: Ordinance 2009-12, Page 7, Item (e) 1 adding “this section does not prohibit a land use permit from allowing the after-hours accessing of the facility for the returning of boats and recreational vehicles.” Supervisor Piepho also noted a typographical correction to page 4 of the staff report: the hearing date given as December 19, 2009 should be corrected to read December 19, 2008.
