HomeMy WebLinkAboutMINUTES - 07072009 - C.40RECOMMENDATION(S): APPROVE and AUTHORIZE the Director of Conservation and Development, or designee, to execute a contract amendment with Goldfarb and Lipman, LLP, extending the term of the contract from June 30, 2009 to June 30, 2010, without change to the payment limit of $115,000, to continue to provide legal services related to housing/economic development programs. FISCAL IMPACT: No General Fund impact. Home Investment Partnership Program (HOME) and Community Development Block Grant (CDBG) funds are provided to the County on a formula allocation basis through the U.S. Department of Housing and Urban Development (HUD). Funding of $65,000 comes from administrative funds currently allocated to each program (approximately $25,000 from CDBG and $40,000 from HOME). Funding of $50,000 comes from Neighborhood Stabilization Program (NSP) Funds, also through HUD. The County also received $6,019,000 in Neighborhood Stabilization Funds. CDBG, HOME and HOPWA funds are typically provided to affordable housing developers in the form of a subsidized loan. The County’s funds are secured against the property by a deed of trust and specific affordability and use restrictions are incorporated into a loan and regulatory agreement between the County and project developer. In addition to housing, approximately $500,000 in CDBG funds are allocated on an annual basis to economic development projects designed to create jobs for low-income persons. These funds are also typically secured against the project property through a deed and loan agreement. On November 18, 2008, the Board approved the Neighborhood Stabilization Plan (NSP) Substantial Amendment to the FY 2008/09 Community Development Block Grant Action Plan. The Substantial Amendment served as the County’s application to the U.S. Department of Housing and Urban Development for NSP funds. Federal regulations allow, and the County has budgeted, 10 percent of these funds for program planning and administration. The County requires ongoing legal advice and documents in order to implement these programs. There is a sufficient balance on the payment limit to continue the contract for the coming year.
