ADOPT Resolution No. 2009/297 accepting the Fiscal Year 2009/2010 Final Engineer’s Report for the County Service Area M-30 (Alamo Springs) and levying the annual assessments for extended police, park and roadside landscape maintenance and public street maintenance services to be placed on the tax roll for Fiscal Year 2009/2010. FISCAL IMPACT: There is no impact to the County General Fund. All costs will be covered with revenue from County Service Area M-30 (Alamo Springs) (100%). Bueren, Public Works Director/Chief Engineer Date:June 23, 2009 Contra Costa County Subject:HEARING to Adopt Resolution No. 2009/297 accepting the Final Engineer's Report for County Service Area M-30 Project No.:7499-6X5491 BACKGROUND: (CONT'D) Board of Supervisors adopted Resolution No. 2009/233 accepting filing of the Preliminary Engineer’s Report for County Service Area M-30 (Alamo Springs) for Fiscal Year 2009/2010, declaring the intent to levy and collect annual assessments, and fixing June 23, 2009 at 9:30 a.m., in the Board Chambers, as the time and place for a public hearing accepting the filing of the Final Engineer’s Report. The annual assessments for County Service Area M-30 (Alamo Springs) are for the purpose of funding municipal services provided by the Town of Danville to the residents living in the unincorporated portion of the Alamo Springs subdivision under a Joint Exercise of Powers Agreement (JEPA) between the County and the Town of Danville. These services include: extended police, park and roadside landscaping maintenance and public street maintenance. A portion of the assessment is also paid to the County’s L-100 Street Lighting District. County Service Area M-30 (Alamo Springs) was first formed in 1997. Residents were assessed beginning in 2000. County Service Area M-30 (Alamo Springs) includes a cost-of-living adjustment to compute the Maximum Authorized Assessment (MAA). The MAA is currently at $822.22. Funds collected through the assessment are used primarily to reimburse the Town of Danville for the cost of providing the above-stated municipal services. CONSEQUENCE OF NEGATIVE ACTION: Without the Board of Supervisor’s approval, County Service Area M-30(Alamo Springs) will not receive funds sufficient to pay the sum requested by the Town of Danville for providing specific municipal services. CLERK'S ADDENDUM The Chair opened the public hearing; there were no public speakers; the Chair closed the public hearing and ADOPTED Resolution No. 2009/297.
