AUTHORIZE the Deputy Director - Redevelopment, or his designee, to enter into a funding agreement with the City of Oakland that authorizes the County to receive and administer $469,463 in federal Housing Opportunities for Persons with AIDS (HOPWA) funds from the Department of Housing and Urban Development, for housing and supportive services for low-income persons with HIV/AIDS; 2. APPROVE the allocation of $310,000 in Fiscal Year 2006/07 Housing Opportunities for Persons with AIDS (HOPWA) funds for the Berrellesa Palms project, Martinez; and 3. REVISE fund allocations from prior year HOPWA Funding Agreements. FISCAL IMPACT: No General Funds impact. CATALOG OF FEDERAL DOMESTIC ASSISTANCE (CFDA NUMBER): Housing Opportunities for Persons with HIV/AIDS (HOPWA) Program – 14.241 BACKGROUND: The National Affordable Housing Act (Public Law 101-625, approved November 28, 1990) authorizes the Housing Opportunities for Persons with AIDS Program (HOPWA) to provide states and localities with resources to devise long-term comprehensive strategies for meeting the housing needs of persons with HIV/AIDS and related diseases. The City of Oakland (City) is the HOPWA grant recipient for Alameda and Contra Costa counties. The City allocates the HOPWA funds between the City and counties on a fair share allocation basis. Approval of a funding agreement with the City of Oakland will provide $469,463 in FY 2008 funds to the County as administering agent on behalf of the Urban County and other Contra Costa entitlement jurisdictions (the cities of Antioch, Concord, Pittsburg, Richmond, and Walnut Creek). These funds may be used for acquisition, rehabilitation and new construction of housing; supportive services; housing information services; and certain other housing related activities for low-income persons with HIV/AIDS. Historically, the County allocates funds to the Health Services Department (HSD) HIV/AIDS program, to housing developments, and to administration. HSD spends its allocation in full every year. The housing development projects often take several years between the fund commitment to start of construction. Prior funds from FY 2005/06 were allocated to the Lillie Mae Jones Plaza project in City of Richmond. This project has experienced several delays; however it is scheduled to break ground this fall. The County needs to accelerate the expenditure of the HOPWA housing development funds from FY 2005/06. In order to accelerate expenditures, staff is recommending the reallocation of funds as follows: • FY 2005/06: $165,772 to HSD leaving $159,585 for Lillie Mae Jones Plaza. • FY 2006/07: $310,000 for Berrellesa Palms, leaving $31,806 in housing development unallocated. • FY 2007/08: $150,415 for the remainder of Lillie Mae Jones Plaza and $110,000 to HSD, leaving $69,239 in housing development unallocated. • The $469,463 in FY 2008/09 would be allocated as follows: $328,750 in housing development funds to be allocated through a competitive application process with recommendations forwarded to the Board of Supervisors for final review and approval. $110,000 funds to HSD for HIV/AIDS programming. $30,713 for Program Administration. These reallocations do not change the overall distribution of funds between HSD, housing development, and administration. HSD will continue to receive an annual allocation of $110,000. Berrellesa Palms The purpose of the Berrellesa Palms project is to provide 49 units of rental housing affordable to and occupied by lower income seniors, including those with HIV/AIDS in Martinez and Central County. Resources for Community Development (RCD) is the developer of the project, which involves the new construction of 48-one bedroom units and 1-two bedroom manager’s unit. Three of the units will be designated for persons living with HIV/AIDS. In accordance with HOPWA regulations, RCD will contract with the HSD Homeless Program to be the lead service agency and direct provider of services to residents of Berrellesa Palms. The Board has previously approved CDBG ($1,525,000) and HOME ($1,350,000) allocations to the project. Staff will return to the Board at a later date with legal documents for CDBG, HOME, HOPWA and CEQA approval.
