1. APPROVE a First Amendment to lease with Balco Properties, Ltd., LLC., to extend the
lease at 825 Arnold Drive, Bay 3, Martinez, for a two-year term commencing May 1, 2009,
and ending April 30, 2011, at a monthly rent of $1,530, for approximately 1,800 square feet
of warehouse space, for the continued use by the Health Services Department, under the
terms and conditions set forth in the First Amendment to Lease. (T00658)
2. AUTHORIZE the Director of General Services, or designee, to EXECUTE the First
Amendment to the Lease on behalf of the County, and to EXERCISE any options to extend
the amended Lease.
3. DETERMINE that the project is a Class 1(a) Section 15301 Categorical Exemption under
the California Environmental Quality Act (CEQA). CP #09-41
4. DIRECT the Department of Conservation and Development Director, or designee, to file
a Notice of Exemption with the County Clerk, and DIRECT the Director of General
Services, or designee, to arrange for the payment of the handling fees to the Conservation
and Development Department and County Clerk for filing of the Notice of Exemption

Subject:First Amendment to Lease for 825 Arnold Drive, Bay 3, Martinez
FISCAL IMPACT:
The First Amendment to Lease will obligate the County to pay a total rent of $38,340 over
the two-year term. The rental amount over the two-year term of the First Amendment to
Lease represents a $3,328 decrease in rents. The new two-year options described in the First
Amendment to Lease are also at rents below the current rental amount. The two-year Lease
does not have a termination clause. The County will pay the PG&E, refuse, and janitorial
costs, and the Lessor will pay for all other maintenance. The Lessor does not provide any
janitorial to the warehouses. The Lease costs were anticipated and budgeted in the Health
Service Department's approved FY 2009/2010 budget.
BACKGROUND:
The Health Services Department Medical Information Systems has occupied the adjacent
Bay 4 space since 2000, and Bay 3 since 2003. The term of this lease and the option
extension for Bay 3 will be coterminous with that for Bay 4.
CONSEQUENCE OF NEGATIVE ACTION:
The Health Services Department Medical Information Systems requires specialized
conditions at this location, such as a demagnetized floor area, and built-in lofts, additional
insulation and coolers that have all been installed at the County's expense. If the County
does not approve the lease, the County will need to look for another location, likely at a
higher cost, which would include the cost of moving.
