HomeMy WebLinkAboutMINUTES - 06232009 - C.34RECOMMENDATION(S): APPROVE and AUTHORIZE the County Administrator, or designee, to execute a Memorandum of Understanding with the Judicial Council of California, Administrative Office of the Courts, for the County General Services Department to provide repair and maintenance services of Court Exclusive-Use and specified Common Areas in County-Court shared facilities through June 30, 2009 for the following court locations: 725 Court Street, Martinez (Wakefield Taylor Courthouse), 1020 Ward Street, Martinez (A. F. Bray Courthouse), 640 Ygnacio Valley Road, Walnut Creek (Walnut Creek Courthouse), 625 Court Street, Martinez (Finance Building basement), 1111 Ward Street, Martinez (File Unit), 202 Glacier Drive, Martinez (Juvenile Court Facility), 1010 Ward Street, Martinez (Jail Annex), and 2020 North Broadway, Walnut Creek (Court Storage). FISCAL IMPACT: All cost incurred by the County for maintaining court facilities through June 30, 2009 and beyond, if renewed by mutual agreement, will be reimbursed by the Administrative Office of the Courts. Lango, General Services Director Date:June 23, 2009 Contra Costa County Subject:Memorandum of Understanding Between the Judicial Council of California, Administrative Office of the Courts, and Contra Costa County BACKGROUND: The Trial Court Facilities Act of 2002, commencing at Government Code § 70301 (the “Act”), provides for the County to transfer responsibility for the funding and operation of all trial court facilities, as defined at Government Code § 70301(d) located in the County to the Judicial Council of California through the Administrative Office of the Courts (AOC). Pursuant to the Act, the County and the AOC have entered into a Transfer Agreement (“Transfer Agreement”) and a Joint Occupancy Agreement (“JOA”) with respect to each of the court facilities known as Wakefield Taylor Courthouse located at 725 Court Street, Martinez; Walnut Creek Courthouse located at 640 Ygnacio Valley Road, Walnut Creek; Bray Court located at 1020 Ward Street, Martinez; Juvenile Court located at 202 Glacier Dr. Martinez; Jail Annex located at 1010 Ward St., Martinez; Finance Building located at 625 Court Street, Martinez; File Unit located at 1111 Ward Street, Martinez; and 2020 N. Broadway, Walnut Creek. The AOC is responsible for the maintenance and repair of the Court Exclusive-Use Area in each court facility and the Common Areas for Wakefield Taylor Courthouse, Bray Court, and the Walnut Creek Courthouse, pursuant to the JOAs. In lieu of the AOC providing for the maintenance and repair of these areas, the AOC desires that the County provide, and the County is willing to provide, these services. The proposed MOU provides the framework within which the AOC can reimburse the County for providing the services through the end of the current fiscal year and beyond, if renewed by mutual agreement. CONSEQUENCE OF NEGATIVE ACTION: If not approved, the Administrative Office of the Courts will not have authority to reimburse the County for maintenance services provided in court facilities between February 1 and June 30, 2009.
