HomeMy WebLinkAboutMINUTES - 06232009 - C.14RECOMMENDATION(S): ADOPT Resolution No. 2009/303 approving deposit of $8,500 by the Contra Costa County Flood Control & Water Conservation District (FC District) to the Flood Control Revolving Fund and approving a loan from the Flood Control Revolving Fund in the amount of $8,500 to Drainage Area 127 (DA 127) for drainage area maintenance, San Pablo area. FISCAL IMPACT: There is no fiscal impact to the General Fund. Funds are deposited by the FC District into the Flood Control Revolving Fund and loaned from the Flood Control Revolving Fund to another drainage entity. The borrowing drainage entity agrees to pay the loan principal and interest over a five-year period. The cost to provide necessary maintenance of DA 127 facilities is expected to exceed available funding by $8,500 in fiscal year 2008-2009. The FC District currently has funds that are temporarily not needed and are available to deposit to the Flood Control Revolving Fund. (Flood Control District Funds) BACKGROUND: Flood control improvements were constructed in lower Rheem Creek by the U.S. Army Corps of Engineers (Corps) and Contra Costa County in the early 1960s. Storm Drain Maintenance District 4 (SDMD4) was established to fund the long-term maintenance of the facilities with property tax revenues. SDMD4 was subsequently converted to DA 127. The FC District is obligated to provide maintenance in accordance with the maintenance standards established by the Corps. Property tax revenues received this year are inadequate to fund needed maintenance and maintenance expenditures are expected to exceed funding by $8,500. FC District staff has been engaged in discussions with the cities of San Pablo and Richmond to identify sources of funding to augment existing revenue. However, additional sources of revenue are not available at this time. DA 127 requires funding to cover expenses accrued to date and expected through the end of the fiscal year for drainage area administration and maintenance. The FC District currently has funds that are temporarily not needed and are available to be deposited into the Flood Control Revolving Fund. The attached resolution requests approval of the deposit from the FC District to the Flood Control Revolving Fund and a loan from the Flood Control Revolving Fund to DA 127. CONSEQUENCE OF NEGATIVE ACTION: If the proposed deposit and loans are not approved, the DA 127 facilities will be inadequately maintained. ATTACHMENTS Resolution No. 2009/303
