HomeMy WebLinkAboutMINUTES - 06162009 - C.74RECOMMENDATION(S): ACCEPT report on the transfer of density on land within the unincorporated area for the Elworthy Ranch Residential Project in the Town of Danville and ADOPT Resolution 2009/291 recognizing the transfer of density from 132 acres of unincorporated land from within the Elworthy Ranch to the Elworthy Ranch Residential Project. FISCAL IMPACT: None. BACKGROUND: The Department of Conservation and Development is in receipt of a final action letter from the Town of Danville, dated July 21, 2008, confirming approval of the Elworthy Ranch Residential Project. The Elworthy Ranch consists of 459 acres with 327 acres within the Town of Danville and 132 acres in the unincorporated area of the County. The residential development approved by the Town of Danville consists of 96 units clustered on 12 acres along San Ramon Valley Boulevard, which is entirely within the jurisdiction of the Town. The project approval also provides that 232 acres of the Elworthy Ranch, including 132 acres within the unincorporated area, be offered to the East Bay Regional Park District to be added into the parkland open space comprising of the Las Trampas Regional Wilderness Preserve. During the project approval process, the Town of Danville prepared an Environmental Impact Report and coordinated with Department staff regarding the County’s recognition of the transfer of density. Attached as Exhibit “0” to this report is a map that illustrates the location of the Elworthy Ranch, the location of the 12-acre residential development area, and the location of the132 acre portion of the Elworthy Ranch in the unincorporated area where the subject transfer of density was approved by the Town of Danville. As a follow-up to their project approval that occurred in 2008, the Town of Danville by letter dated May 6, 2009 has now requested the County to formally recognize the transfer of density from the 132 acre portion of the Elworthy Ranch within the unincorporated area to the 12-acre residential development area that is within the Town of Danville. Attached for the Board’s consideration is a resolution that formally recognizes the Elworthy Ranch density transfer. CONSEQUENCE OF NEGATIVE ACTION: None. CHILDREN'S IMPACT STATEMENT: None.
