APPROVE template for “Memorandum of Understanding between any City in the County
and the County of Contra Costa regarding loan of County’s Green Building Materials
Display” ,and; AUTHORIZE the Department of Conservation and Development Director,
or her designee, to prepare and execute a “Memorandum of Understanding between any
City in the County and the County of Contra Costa regarding loan of County’s Green
Building Materials Display” with each requesting City, using the template approved by
County Counsel’s office, prior to loaning out the County’s Display.
FISCAL IMPACT:
No impact to the County General Fund. The City borrowing the Display would be
responsible for repairing and replacing the Display if damaged as well as liable for any
injuries or damage caused by the Display while in the City’s custody.

BACKGROUND: (CONT'D)
grant funding from the State. This 7 ft high by 4 ft wide Display contains more than
fifteen environmentally friendly construction materials, such as carpeting made with
recycled plastic water bottles and a counter top made with recycled glass bottles. The
Display is intended to give the public an opportunity to learn about and view samples of
environmentally conscious building materials that can be used in new homes or in
remodeling projects. The Display is currently located on the 4th floor of the 651 Pine
Street North Wing building.
When the Display was purchased, staff envisioned loaning the Display temporarily to
other jurisdictions in the County so it could be displayed in various locations which
would encourage a wider range of local builders to use green building materials. Because
of the large size of the Display, an MOU was prepared to protect the County against any
liability resulting from relocation of the Display. Furthermore, the MOU requires the
City to repair or replace the Display if it is damaged while in the care, custody, or control
of City staff, however caused. Each City that has requested to borrow the Display has
been asked to sign an MOU. The Display has been transported and used by the cities of
Antioch, Concord and El Cerrito in recent years.
In the past, the MOU was only executed following the Board’s approval. Staff
recommends the Board provide authorization to execute individual MOUs with local
Cities requesting to borrow the Display using the MOU template which has been
approved by County Counsel on May 29, 2009. If approved by the Board, this MOU
template could be completed each time without having to be approved individually by
the Board of Supervisors and County Counsel’s office. The MOU would still require the
signature of the Director of Conservation and Development Department or her designee,
and the signature of the City’s designee. After each MOU is executed, the City would be
allowed to temporarily re-locate the Display to the location within the City designated in
the MOU.
