HomeMy WebLinkAboutMINUTES - 12101985 - T.6 7L ORDINANCE NO. 85-77 URBAN WEST DEVELOPMENT AGREEMENT PLEASANT HILL BART STATION SPECIFIC PLAN AREA 15 The Contra Costa County Board of Supervisors ordains as follows: Section I. The Board hereby finds that the provisions of that certain -Development Agreement by and between the County of Contra Costa, the Contra Costa County Redevelopment Agency, Urban West Communities and UWC-Oak Road Ltd. , relative to the development known as Urban West-Pleasant Hill BART Station Specific Plan Area (Area 15 Pleasant Hill BART Station Specific Plan) , a copy of which is on file with the Clerk of the Board, which has been recommended for approval by the County Zoning Administrator, . is consistent with the County's General Plan and conditions of approvals for Area 15 of the Pleasant Hill BART Station Specific Plan. Section II. The Board hereby approves, pursuant to the authoriza- tion provided in Section 65864 et seq. , of the Government Code of the State of California entering into that certain Development Agreement by and between the County of Contra Costa, the Contra Costa County Redevelopment Agency, Urban West Communities and UWC- Oak Road Ltd. , relative to the development known as Urban West- Pleasant Hill BART Station Specific Plan Area (Area 15 Pleasant Hill BART Station Specific Plan) , subject to review and approval of the Community Development Department and County Counsel. Section III. If any section, subsection, subdivision, para- graph, sentence, clause or phrase of this ordinance is for any reason held to be unconstitutional or invalid, such a decision shall not affect the validity of the remaining portions of this ordinance. The Board hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause or phrase of this ordinance irrespective of the unconsti- tutionality or invalidity of any section, subsection, subdivision, paragraph, sentence, clause or phrase. Section IV. EFFECTIVE DATE. This Ordinance becomes effective 30 days after publication, and s a 1 be published once with the names of the supervisors voting for and against it in the Contra Costa Times , a newspaper published in this County.
