Approve and authorize the Health Services Director, or his designee (Jeff Smith, M.D.), to
execute, on behalf of the County, as follows:
1. Cancellation Agreement #26 904-18 with Stephen D. Weiss, M.D. (Specialty: General
Surgery), a self-employed individual, effective on the close of business on May 31, 2009;
and
2. Contract #26-904-19 with Stephen D. Weiss, M.D. (Specialty: General Surgery), a
self-employed individual, in an amount not to exceed $1,300,000 for the provision of
professional general surgery services for patients at Contra Costa Regional Medical Center
and Contra Costa Health Centers, for the period from June 1, 2009 through May 31, 2011.
FISCAL IMPACT:
This Contract is funded by Enterprise Fund I. Cost to the County depends upon utilization.
As appropriate, patients and/or third party payors will be billed for services.

Subject:Cancellation Agreement #26-904-18 and Contract #26-904-19 with Stephen D. Weiss, M.D.
BACKGROUND:
On January 9, 2007, the Board of Supervisors approved Contract #26-904-16 (as amended
by Amendment Agreement #26-904-17) with Stephen D. Weiss, M.D., to provide general
surgery services including clinic coverage, consultation, training, on-call and medical and/or
surgical procedures, for patients at Contra Costa Regional Medical Center and Contra Costa
Health Centers, for the period from January 1, 2007 through December 31, 2009.
In consideration of Contractor’s agreement to continue providing services, both parties have
agreed to re-negotiate payment terms. This will allow the Contractor provide expanded
duties due to leave of other general surgery. The Department and the Contractor have
mutually agreed to renegotiate the Contract Payment Provisions and the term to reflect the
intent of the parties. Therefore, in accordance with Special Conditions, Paragraph 2.
(Modification to Termination and Cancellation) of the Contract, the Department and
Contractor have agreed to a mutual cancellation of Contract #26-904-16 (as amended by
#26-904-17). Approval of Cancellation Agreement #26-904-18 will accomplish this
termination.
Under Contract #26-904-19, Contractor will provide professional general surgery services,
including, clinic coverage, consultation, training, on-call services, and medical and/or
surgical procedures, through May 31, 2011.
