1. APPROVE Department of Conservation and Development staff recommendations for the
allocation of $929,719 in FY 2008/09 Community Development Block Grant-Recovery
(CDBG-R) funds under the American Recovery and Reinvestment Act of 2009;
2. APPROVE Substantial Amendment #3 to the Contra Costa County FY 2008/09 CDBG
Action Plan and AUTHORIZE the Deputy Director-Redevelopment, or his designee to
execute the appropriate documents for transmittal to the U.S. Department of Housing and
Urban Development (HUD);
3. DETERMINE that Substantial Amendment #3 to the Contra Costa County FY 2008/09
CDBG Action Plan is exempt from the California Environmental Quality Act (CEQA)
pursuant to Section 1506 (b)(3) of the CEQA Guidelines;
4. DIRECT the Conservation and Development Director to file a Notice of Exemption for
Substantial Amendment #3 to the FY 2008/09 CDBG Action Plan with the County Clerk;
5. AUTHORIZE the Deputy Director-Redevelopment or his designee to execute the

RECOMMENDATION(S): (CONT'D)
FISCAL IMPACT:
No General Fund impact. All funds are provided to the County on a formula basis
through the U.S. Department of Housing and Urban Development (HUD). The CDBG-R
funds are part of the stimulus package approved by the federal government under the
American Recovery and Reinvestment Act of 2009. A portion of the funds (10%) are
reserved for program administration in the Conservation and Development Department.
CFDA# 14.253 (CDBG-R Program - Entitlements)
BACKGROUND:
The American Recovery and Reinvestment Act of 2009 (Recovery Act) was signed into
law by President Obama on February 17, 2009, in an effort to jumpstart the U.S.
economy, create and save jobs, and address neglected infrastructure and public facilities.
The Recovery Act includes $13.61 billion for projects and programs administered by the
Department of Housing and Urban Development (HUD), of which 75 percent was
allocated to state and local recipients on February 25, 2009.
Contra Costa County received a special supplemental allocation of Community
Development Block Grant funds (CDBG-R) under the Recovery Act in the amount of
$929,719 . This is part of $1 billion allocated to approximately 1,200 state and local
governments to invest in their own community development priorities – stabilizing
communities and creating jobs locally. These investments will support a broad range of
housing and community development projects that benefit lower income persons/families
and are ready to go or “shovel ready.” Many of these projects have been held up for lack
of private investment due to fallout from the broader economic crisis and credit crunch.
Available Funds and Activity/Project Criteria
There is a total of $836,747 of Contra Costa County CDBG-R funds available for
infrastructure and public facilities projects/activities that provide benefits to
lower-income residents or activities that promote energy efficiency and conservation
through the rehabilitation or retrofitting of existing buildings. An additional $92,972 will
be withheld for CDBG Program Administration (10% allowed by program regulations).
HUD's guidelines for CDBG-R funds indicate that awarded activities are required to
create or retain jobs or promote economic opportunity for lower income
persons/households; or promote energy conservation, smart growth, green building
technology, or reduce pollution emissions. Each awarded project/activity must estimate
the number of jobs created or retained; or provide a description of how the activities
promote energy conservation, smart growth, green building technology, or reduce
pollution emissions. Awarded projects/activities must be “shovel-ready” projects that can
be initiated within 120 days of award approval, which is anticipated to be on or about
July 7, 2009, and be completed within approximately one year.
Request for Proposals Timeline and Recommendation of Project/Activities
HUD notified jurisdictions of the Program Requirements on May 6, 2009. In order for
qualified jurisdictions to receive its CDBG-R grant allocation, a substantial amendment
with a list of project/activities to undertake with these funds must be submitted to HUD
by June 5, 2009. In order to meet this deadline, a Notice of Funding Availability/Request
For Proposals (RFP) was e-mailed to a county-wide interested parties list on May 8, 2009
and posted to the County website on May 11, 2009. The RFP deadline was May 18, 2009.
A total of 43 eligible applications were submitted by the May 18, 2009 deadline, of
which 14 projects are recommended to receive CDBG-R funds (see Exhibit A). County
staff recommended CDBG-R funds to projects/activities that met HUD's guidelines and
priorities for use of these funds. In addition, staff prioritized projects/activities that have
been funded with FY 2008/09 CDBG funds and have a funding gap, and/or are from
agencies that have performed well with previous infrastructure or building rehabilitation
projects. Initial estimates indicate approximately 352 jobs will be created or retained as
part of the County's CDBG-R program.
HUD's timeline indicates that activities/projects must be initiated within 120 days of
award approval and must be completed by September 30, 2010. If projects cannot meet
this deadline or cannot follow through with HUD's guidelines for the CDBG-R funds,
County staff would return to the Board of Supervisors to recommend other eligible
"ready-to-go" projects from the list of project/activities that were not recommended
funding at this time.
California Environmental Quality Act
Substantial Amendment #3 to the FY 2008/09 CDBG Action Plan is exempt from CEQA
review. However, individual projects may be subject to further review, which will be
undertaken by the lead agency.
CONSEQUENCE OF NEGATIVE ACTION:
If the County does not submit its Substantial Amendment to the FY 2008/09 Action Plan
to HUD by the June 5, 2009 deadline, the County will not receive its $929,719 allocation
of CDBG-R funds.
