The Department has selected RBF Consulting for preparation of the environmental documents for these two projects. Staff recommends that the Board approve and authorize the contract with a modified indemnification clause. The modified language has been reviewed and approved by Risk Management and County Counsel. In May of 2008, the Board of Supervisors adopted Ordinance No. 2008-87 which established new procedures and amendments for contracts. The ordinance requires any contract that deviates from the standard County indemnification provisions to receive Board of Supervisors consideration and approval. The general conditions of the County long form contract contains an indemnification clause which will omit the following language: "If County elects to provide its own defense, the contractor will reimburse the County for any expenditures, including reasonable attorney's fees and costs."
