THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA

IT IS BY THE BOARD ORDERED:
Whereas , by a final decision of the California Court of
Appeal , in City_of_Sacramento_v__State of California (1984 ) 156
Cal .App. 3d 182 , 203 Cal .Rptr . 258 , hear-ing denied , it has been
determined that the insurance premiums and other local government
costs of the state unemployment insurance law (1978 Statutes ,
chapter 2 ) , are costs mandated by the state for which state reim-
bursement is required by California Constitution Article XIII B,
Section 6, and Revenue and Taxation Code Section 2231 , subdivision
(a) ; and
Whereas , the Employment Development Department of the State
Health and Welfare Agency has continued since the City of
Sacramento decision to bill counties and other local governments
unemployment insurance benefit charges incurred by the program and
has threatened to assess penalties and interest if those charges
are not timely paid,
Now, Therefore , the Contra Costa County Board of Supervisors
petitions the California Legislature, at its December , 1984
session, to enact legislation providing for the State assumption
of all county and other local government unemployment insurance
benefit charges for the 1984-85 fiscal year .
Further , the Contra Costa County Board of Supervisors peti -
tions the California Legislature to enact legislation providing
for the state assumption of all future county and other local
government unemployment insurance benefit charges and local admini-
strative costs .
Finally , the Contra Costa County Board of Supervisors
petitions the California Legislature to enact legislation pro-
viding for the full reimbursement of all county and other local
government unemployment insurance benefit charges and local admini -
strative costs heretofore incurred, with interest .
The County Administrator is directed to include this order as
part of Contra Costa County ' s 1985 legislative program.
