re-zoning the land in the above area shown shaded on the map(s) attached hereto and incorporated herein
(see also Department of Conservation and Development File No. _____________________ .)

NOTICE OF PUBLIC HEARING BEFORE THE CONTRA COSTA
COUNTY BOARD OF SUPERVISORS ON PLANNING MATTERS
COUNTYWIDE / BYRON/ DISCOVERY BAY AREA
Notice is hereby given that on Tuesday, May 19, 2009 at 1:15 p.m., in the County Administration
Building, Board Chambers, 651 Pine Street (Corner of Pine and Escobar Streets), Martinez,
California, the Contra Costa County Board of Supervisors will conduct a public hearing to
consider the following planning matter:
Proposed Boat Storage (-BS) Combining District
A recommendation from the County Planning Commission on a County-initiated
proposal relating to boat and recreational vehicle storage within lands zoned for
agricultural use that includes the following actions:
1. Zoning Text Amendment, County File: ZT#08-0003: The adoption of an
ordinance text amendment to add Chapter 84-78, Boat Storage (-BS)
Combining District, to the County Ordinance Code, which would: a) allow
boat storage areas to be established in agricultural zoning districts beyond one
mile from a public boat launch upon issuance of a land use permit; b) provide
that vessels, vessel trailers, and recreational vehicles, along as the number of
recreational vehicles does not exceed 25 percent of the storage spaces, may be
stored in a boat storage facility within the combining district; c) establish
development standards for a boat storage facility within the combining district;
and, d) amends several other sections to the County Ordinance Code, including
subsection (21) of Section 84-38.404 of the code to provide that recreational
vehicles may be stored in a boat storage facility located within one mile of boat
launching facility, as long as the number of recreational vehicles does not
exceed 15 percent of the total number of spaces in the storage area, and the
addition of “recreational vehicle” to Chapter 82-4 of the code, it amends the
code to relocate the definitions for “vessel”, vessel trailer”, “manufactured
home”, “mobile home”, and “travel trailer” from Chapter 84-68 to Chapter 82-
4, and it amends Section 84-68.102 and 84-68-1404 to clarify that recreational
vehicles are prohibited from being used for human habitation in most zoning
districts, and that recreational vehicles are allowed to be stored at residences
along as they are screened from view. (Countywide)
2. Rezoning, County File: RZ#08-3208: The adoption of a rezoning ordinance to
apply the new Boat Storage (-BS) Combining District to lands zoned for
agricultural use in the vicinity of Discovery Bay along the south side of State
Route 4, extending approximately 4000-4200 feet from the edge of the road
right-of-way generally from Regatta Drive to Discovery Bay Boulevard, so that
the Boat Storage (-BS) Combining District is combined with the applicable
underlying zoning districts. (Byron / Discovery Bay)
The location of the project is within the unincorporated territory of Contra Costa County, State of
California, (a more precise description may be examined in the Office of the Director,
Department of Conservation and Development, County Administration Building, Martinez,
California).
For the purposes of compliance with the provisions of the California Environmental Quality Act
(CEQA), a Negative Declaration has been prepared for this project.
If you challenge this matter in Court, you may be limited to raising only those issues you or
someone else raised at the public hearing described in the notice, or in written correspondence.
Prior to the hearing, Department of Conservation and Development staff will be available on
Tuesday, May 19, 2009 at 12:30 p.m. in Room 108, Administration Building, 651 Pine Street,
Martinez, CA, to meet with any interested persons in order to: (1) answer questions; (2) review
the hearing procedures used by the Board; (3) clarify the issues being considered by the Board;
and, (4) if necessary, provide an opportunity to identify, resolve, or narrow any differences which
remain in dispute. If you wish to attend this meeting with staff, please call Patrick Roche,
Department of Conservation and Development, at (925) 335-1242 by 3:00 p.m. on Monday, May
18, 2009 to confirm your participation.
