("Kel-Tec"), Martinez, the lowest responsive and responsible bidder for the subject project, and AUTHORIZE the General Services Director, or designee, to execute the contract. 2. DETERMINE that Kel-Tec Builders, Inc., as the lowest responsive and responsible bidder, has documented an adequate good faith effort to comply with the specifications and requirements of the County's Outreach Program. 3. AUTHORIZE the General Services Director, or designee, to exonerate any bid bond posted by the bidder after execution of the contract. 4. AUTHORIZE the General Services Director, or designee, to sign any escrow agreements prepared for this project to permit the direct payment of retentions into escrow or the substitution of securities for monies withheld by the County to ensure performance under the contract, pursuant to Public Contract Code Section 22300. 5. Lango, General Services Director Date:May 19, 2009 Contra Costa County Subject:Award of Construction Contract for the Expansion of the Homeless Shelter Project, 2047-D Arnold Industrial Way, Concord, Health Services Department RECOMMENDATION(S): (CONT'D) AUTHORIZE the General Services Director, or designee, to order changes or additions to the contract work pursuant to Public Contact Code Section 20142. 6. DELEGATE, pursuant to Public Contract Code Section 4114, the Board's functions under Public Contract Code Sections 4107 and 4110, with regards to subletting and subcontracting, to the General Services Director, or designee. FISCAL IMPACT: The construction cost of $782,200 will be funded from the Emergency Housing Assistance Program ("EHAP") Capital Development funds as awarded by the State of California for this project. BACKGROUND: The Health Services Department has secured a state grant to expand the current homeless shelter it operates at 2047-C Arnold Industrial Way, Concord. The homeless shelter will expand into the adjacent building suite, providing an additional 8,500 square feet of space. The project involves remodeling this space to provide a respite care clinic and program. The respite care program will provide outreach, short-term shelter, goal-oriented counseling, and health services to medically fragile homeless individuals recently discharged from hospitals. The project plans and specifications were previously filed with and approved by the Board of Supervisors and bids were duly invited from general contractors. Six bids were received and opened by the General Services Department on April 23, 2009, and the bid results are as follows: BIDDER BASE BID Kel-Tec Builders, Inc., Martinez $782,200 Murray Building, Sonoma $790,000 Albay Construction, Martinez $898,000 Rudolph Commercial Interiors, Inc., Oakland $927,502 River View Construction, Sacramento $967,000 J.W. & Sons, Inc., Petaluma $969,300 All bids were below the architect’s estimate of $1,368,000. The bidder listed first above, Kel-Tec Builders, Inc., submitted the lowest responsive and responsible bid, which is $7,800 lower than the next lowest bid. Staff recommends that the contract be awarded to Kel-Tec. The general prevailing rates of wages, which shall be the minimum rates paid on this project, are on file with the Clerk of the Board and copies are available to any party upon request. Kel-Tec submitted its documentation of good faith efforts to comply with the specifications and requirements of the County’s Outreach Program. Based on the outreach performed by Kel-Tec and the documentation submitted, staff recommends that the Board determine that Kel-Tec has documented an adequate good faith effort and is in compliance. CONSEQUENCE OF NEGATIVE ACTION: If the Contract is not awarded, the project would not be built and the EHAP capital funding would be lost.
