Lango, General Services Director Date:May 19, 2009 Contra Costa County Subject:Lease Amendment for 309 Diablo Road, Danville for the District 3 Supervisor RECOMMENDATION(S): (CONT'D) AUTHORIZE the Director of General Services, or designee, to EXERCISE the First Amendment to the Lease. DETERMINE that the project is a Section 15061(b)(3) Categorical Exemption under the California Environmental Quality Act (CEQA). CP # 09-17 DIRECT the Department of Conservation and Development Director, or designee, to file a Notice of Exemption with the County-Clerk, and DIRECT the Director of General Services, or designee, to arrange for the payment of the handling fees to the Department of Conservation and Development and County Clerk for filing of the Notice of Exemption. FISCAL IMPACT: The First Amendment to the Lease will obligate the County to pay a rent of $180,300 over the four year extension term. That rent amount represents a reduction in rent of $17,520 that has been negotiated with the landlord for the four year extension term. BACKGROUND: The County has leased this location for the District III Supervisor's office since March 1997. The current District III Supervisor has occupied the office at this location for the past four years. The First Amendment to the Lease includes an extension option to extend the lease for four more years together with a reduced rent that has been negotiated with the landlord. Other lease expenses, such as utilities and janitorial, are not included in the base rent. CONSEQUENCE OF NEGATIVE ACTION: Failure to exercise the First Amendment to the Lease will terminate the lease for the District III Supervisor at this location, and the County will have to find other office space for the Supervisor, likely at a higher cost.
