HomeMy WebLinkAboutMINUTES - 05122009 - C.45RECOMMENDATION(S): Approve and authorize the Health Services Director, or his designee (Jeff Smith, M.D.), to execute on behalf of the County, Contract Amendment Agreement #26 856-26 with Diablo Pulmonary Medical Group, effective May 1, 2009, to modify the payment provisions to reflect the intent of the parties regarding the rate per session with no change in the original Payment Limit of $290,000 and no change in the original term of November 1, 2008 through October 31, 2011. FISCAL IMPACT: Funding for this Contract is 100% included in the Enterprise Fund I. Cost to the County depends upon utilization. Due to the mutual mistake of the County and the Contractor, the Contract payment provisions did not accurately reflect the intent of the parties, which was that the Contractor be paid at a rate of $14,400 for provision of sixteen (16) clinic session instead of the previously stated $14,000. Approval of Contract Amendment Agreement #26-856-26 will modify the Contract Payment Provisions, to make the formal Contract consistent with the oral agreement, which was negotiated with the Contractor and allow the Contractor to continue providing services through October 31, 2011.
