Approve and Authorize the Librarian, or designee, to execute a four-year contract with
OverDrive, Inc. in an amount not to exceed $57,600 with limited contractor indemnification
and liability, to provide digital access to audio books, eBooks, music, and videos to lend to
patrons for download from May 1, 2009 through April 30, 2013.
FISCAL IMPACT:
The total amount of the contract is $57,600 and is included in the Library’s 2009/10 budget.
BACKGROUND:
The Contra Costa County Library has offered digital collections of audio books, eBooks,
video, and music since 2000. Previously, the Library obtained OverDrive’s services through
the OverDrive Northern California Digital Library, a consortium of Califa, a library
membership-based service bureau that provides value-added

discount pricing. As of September 2008, OverDrive, Inc. discontinued its partnership with
Califa and Northern California libraries need to transition to individual contract status in
order to continue the provision of digital collections. As a result of the transition the Library
was able to obtain this contract at a savings of $2,600 annually with a one time contribution
of $12,000 worth of materials from OverDrive, Inc. as an opening day collection.
The Library has actively and successfully implemented and marketed library services to
commuters since a 2001 article in the Contra Costa Times published a report on commute
times stating that Contra Costa County workers have the 10th worst commute in the nation
and the longest commute time west of the Mississippi River as well as the longest in the
Bay Area. These statistics are reaffirmed in a January 26, 2006 Contra Costa Times article.
According to 2010 projections, produced by the Metropolitan Transportation Commission
and the Association of Bay Area Government (ABAG) in 2003, 63,508 people will
commute daily to San Francisco from Contra Costa County; 120, 274 will commute to
Alameda County; 15,169 will commute to Santa Clara County; and 12,648 will commute to
San Mateo County. A more recent report from ABAG states that today 40% of Contra Costa
County residents – compared to 30% of all Bay Area residents - work in one of the eight
other Bay Area counties or outside the region. With a population of over one million,
commuters number approximately 402,600 workers.
Having access to thousands of digital titles that can be downloaded to a mobile device, to a
computer, or burned to disc for convenient listening assists customers in obtaining reading
material at any time, 24/7. Also, through the individual contract with OverDrive, Macintosh
[MAC, Apple, iPod] users will have access to a Macintosh-based platform and the popular
MP3 format.
For warranty issues, this contract has a limitation of liability and conditional
indemnification that has been reviewed with County Counsel.
