APPROVE the 2009 Slurry Seal and Cape Seal Surface Treatment project and FIND the
project is a California Environmental Quality Act (CEQA), Class 1c Categorical Exemption,
pursuant to Article 19, Section 15301c of the CEQA Guidelines, and
DIRECT the Director of Conservation and Development to file a Notice of Exemption with
the County Clerk, and
AUTHORIZE the Public Works Director to arrange for payment of a $25 fee to
Conservation and Development for processing, and a $50 fee to the County Clerk for filing
the Notice of Exemption, and
AUTHORIZE the Public Works Director, or designee, to advertise the project.

FISCAL IMPACT:
The estimated project cost is $1,000,000. This project is funded by Proposition 42 Funds
(100%).

Subject:APPROVE the 2009 Slurry Seal and Cape Seal Surface Treatment project and FIND it is exempt from
California Environmental Quality Act (CEQA)
BACKGROUND:
Slurry Seal and Cape Seal are surface treatments that Contra Costa County (County)
applies to selected roads each year. Both surface treatments extend the life of the existing
pavement by providing a membrane to the roadway surface to prevent water from
seeping under the pavement that could rapidly deteriorate the road.
The project consists of cleaning the road surface (including weed removal and sweeping),
removing existing striping and markers, applying a slurry seal and/or cape seal treatment
to roadways, restriping, and site cleanup in various locations throughout the
unincorporated areas of the County.
Residential streets will be closed for approximately half a day in order to apply the
surface treatments and to provide sufficient time for it to adhere to the road surface.
Residents will be notified one week prior to any activity and “No Parking” signs will be
posted the day before actual application. Emergency vehicle access will be allowed at all
times. Real property transactions, including right-of-way acquisition, may be necessary in
support of this project. Tree branches and shrubbery may need trimming throughout the
project.
Location: The project is located within 5 site areas of unincorporated Contra Costa
County (County) which will receive slurry seal and/or cape seal road surface treatments;
Site 1 is located in the unincorporated community of Alamo on Danville Boulevard; Site
2 is located in the unincorporated area of El Sobrante (Olinda Rd./Castro Ranch Rd. area)
near San Pablo Dam Rd.; Site 3 is located in the unincorporated area of El Sobrante near
Appian Way; Site 4 is located in the unincorporated area of San Pablo (N.
Arlington/Hillcrest Rd. area); and, Site 5 is located in the unincorporated areas of Pinole
and San Pablo (Bay View and Tara Hills area).
There is no possibility that the project may have a significant adverse effect on the
environment. The project consists of the operation, repair, and maintenance of existing
facilities involving no expansion of use beyond that previously existing, pursuant to
Section 15301(c) of the CEQA Guidelines. The project will not result in the removal of
any scenic resource.
CONSEQUENCE OF NEGATIVE ACTION:
Delay in approving the project will result in a delay of design and construction and may
jeopardize funding.
