SUBJECT: Moraga Fire District Resolution
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION: Refer to Internal Operations Committee and that staff, Planning and
Public Works , meet with a committee of various fire districts to review the issues and
then report to the I-0 Committee.
BACKGROUND:
Subdivision 6057 was denied by the Board of Supervisors on November 16, 1982.
Thereafter, a new application was submitted on July 5, 1984 (Donald T. Henderson,
applicant - Kenneth R. Peterson, owner) to rezone the subject area to a Planned Unit
District (2604-RZ) . This request was accompanied by a Final Development Plan Appli-
cation (3030-84) along with a Tentative Subdivision Map Application (Subdivision 6527).
The subject area for these applications is an approximate 111-acre area lying generally
between Hall Drive and Descanso Drive in the Orinda area adjoining the Town of Moraga.
The applicant is proposing 48 dwelling units on this site.
An EIR was prepared for Subdivision 6057 which was certified to be adequate by the
Orinda Area Planning Commission (OAPC) following public hearings. Subdivision 6057
proposed 100 dwelling units which were addressed by the Final EIR. - The OAPC, through
a public hearing, is in the process of determining whether to use this EIR for the
current group of applications proposing 48 units for the same site. In this prior EIR,
the questions raised by the Moraga Fire District were addressed.
The current applications have not, as yet, been determined to be complete because of
information such as grading plans, etc. which have not been received. When the applica-
tions are determined to be complete, staff will then prepare its report and recommenda-
tion which will then be subjected to a public hearing before the OAPC.
The letter and resolution sent to the Board of Supervisors on October 26th by the Moraga
Fire District has been referred to our department. As has been indicated, Subdivision
6057 was denied previously. Some of the issues, however, raised by the Fire District
remain with the current applications for the same site. The thrust of the Fire District's
concern is primarily road standards for subdivisions in hilly areas. Rather than go into
a detailed analysis of the road designs for the pending development (the project itself
is not expected to be heard and decided by the OAPC until January or February next)
inasmuch as the Planned Unit District, if approved by the OAPC, will then come before
the Board of Supervisors for a public hearing and its determination, we would suggest
that the question of subdivision road standards be referred to the Inter al Operations
Committee and that staff, Planning and Public Works, meet with a commix ee of the various
.fire districts to review the issues and then report to the nternal 0 rations Committee.
