HomeMy WebLinkAboutMINUTES - 11271984 - 2.2 TO: BOARD OF SUPERVISORS Contra FROM: Phil Batchelor, County Administrator OP Costa DATE: November 16, 1984 county SUBJECT: Establishment of County Ordinance Setting Trial Juror Fees SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATION Introduce ordinance establishing compensation of trial juror civil and criminal cases at $10. 00 per day in accordance with provisions of AB 3951, waive reading and fix December 4 , 1984 for adoption. BACKGROUND During the legislation session, AB 3951 was approved and chaptered into law effective January 1, 1985, which provides for an increase in the compensation to trial jurors in civil and criminal cases. The present compensation is $5. 00 per day. AB 3951 provides that the fees would increase to $25. 00 per day unless a different fee of not less than $10. 00 per day is set by county ordinance. State reimbursement is available for the $5 . 00 increase from the present $5. 00 fee to the $10. 00 minimum. However, no additional reimbursement is available should the county set the fees at $25 . 00. An analysis of current juror costs indicates that if the county were to increase the juror fees above $10. 00, that the cost to the county would be approximately $300, 000 for each $5. 00 increment in the fee. The additional cost to the county would approximate $900, 000 if the trial juror fees were increased to the $25. 00 maximum as set forth in AB 3951 .
