APPROVE a no fee Access License Agreement , commencing April 7, 2009, with the
East Bay Regional Park District (EBRPD) for the County to access the East Bay
Municipal Water District's (EBMUD) communications site at Pearl Ridge Reservoir,
Richmond, through EBRPD's Wildcat Canyon Regional Park, under the terms and
conditions set forth in the Access License Agreement.

Subject:Access License Agreement with East Bay Regional Park District at Wildcat Canyon Regional Park for the
Department of Information Technology
RECOMMENDATION(S): (CONT'D)
AUTHORIZE the Director of General Services, or designee, to EXECUTE the Access
License Agreement.
DETERMINE that the project is a Section 15061 (b)(3) Categorical Exemption under the
California Environmental Quality Act (CEQA). CP # 08-100
DIRECT the Department of Conservation and Development Director, or designee, to file a
Notice of Exemption with the County Clerk, and DIRECT the Director of General
Services, or designee, to arrange for the payment of the handling fees to the Department of
Conservation and Development and County Clerk for filing the Notice of Exemption.
FISCAL IMPACT:
Approval of the Access License Agreement will result in no cost to the County.
BACKGROUND:
The Access License Agreement will allow access to the EBMUD's communications site by
the Department of Information Technology to install new radio communications equipment
that is part of the East Bay Regional Communications System. An agreement for the long
term use of EBMUD's communications site will be negotiated separately with EBMUD.
CONSEQUENCE OF NEGATIVE ACTION:
The County would have to search for another suitable location to install the EBRCS
communications equipment with loss of time and at considerable expense.
