SUBJECT: Proposed 1985 Legislative Program
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
Adopt the attached as the County's Legislative Program for 1985; authorize the
County Administrator to solicit authors for such measures or to indicate the
Board's support for such measures, and authorize County staff to indicate to
legislators that the Board is on record with these identified positions.
BACKGROUND:
On November 6, 1984, the County Administrator filed a proposed 1985 Legislative
Program with the Board and indicated that a final program would be recommended on
November 27, 1984. Some changes have been made to the preliminary program and
several measures have been added.

PROPOSED 1985 LEGISLATIVE PROGRAM
1 . Sponsor or support legislation to reintroduce a one-time surcharge
on vehicle registration fees for the purpose of funding an active
abandoned vehicle removal program.
2. Sponsor or support legislation to apportion liability on the basis
of the extent to which the defendant is guilty rather than equally
on all defendants regardless of the extent of their guilt.
3. Sponsor or support restoration in the 1985-1986 State Budget of Public
Defender funding provided for in Penal Code Section 987.6.
4. Sponsor or support legislation which provides the Board of Supervisors
with more flexibility in contracting for services than is now possible
under Government Code Section 31000.
5. Sponsor or support legislation which authorizes the Board of Supervisors
to provide for a per diem payment to members of the Advisory Housing
Commission.
6. Sponsor or support legislation which would authorize the Board of
Supervisors to restrict the parking of recreational vehicles and trailers
on public streets in selected areas .
7. Sponsor or support legislation which would authorize the California
Highway Patrol to use radar on non-State highways.
8. Sponsor or support legislation which would increase the traffic school
assignment fee to cover the actual costs of the program.
9. Sponsor or support legislation which would increase the fee which may
be imposed on a bad check transaction to more nearly cover the actual
cost of processing these transactions.
10. Sponsor or support legislation which will require a police officer to
solicit and a motorist to verify the mailing address on traffic citations.
11 . Sponsor or support legislation which would authorize the District Attorney,
at his discretion, to charge a violation of Vehicle Code Section 14601 .1
(driving on a suspended license) as an "infraction" rather than requiring
that all such violations be charged as misdemeanors .
12. Sponsor or support legislation which would expand the discretion of the
District Attorney to charge specified minor offenses as infractions
rather than misdemeanors.
13. Sponsor or support legislation which would provide for and fund a pilot
program to develop and test specific clinical strategies to properly
assess and treat adults who are diagnosed as both mentally disturbed and
substance abusers.

14. Sponsor or support legislation which would remove any unnecessary
requirements that notice of a hearing be posted on the affected
property.
15. Sponsor a municipal court pay and staffing bill for Contra Costa
County which would bring current State law in line with various
personnel actions taken by the Board in the past year.
16. Sponsor or support legislation which would provide for a fee for
the filing of an assessment appeal .
17. Sponsor or support legislation which would authorize an advisory
housing commissioner to simultaneously serve as a planning commissioner.
18. Sponsor or support legislation which would require the State to pay
local government money owed in a more timely fashion.
19. Sponsor or support legislation which would increase civil process
fees and which would establish a cancellation fee of $10 to be paid
in instances where files have been processed and the service is canceled
prior to an attempt at service.
20. Sponsor or support legislation which would amend Government Code
Section 68097.1 and 68097.2 to include non-peace officer employees of
a law enforcement agency as persons who are entitled to continue
receiving their salary when they are required to appear in a civil
action as a direct result of an event resulting from his/her duties
and for whom a deposit of $125 per day must be deposited with the court
clerk by a party who subpoenas such non-peace officer employees of a
law enforcement agency.
21 . Sponsor or support legislation which would prohibit the release of the
name of a victim of a sex crime unless the victim specifically authorizes
such release rather than requiring the victim to specifically prohibit
such release.
22. Sponsor or support legislation which would more clearly distinguish
between criminal and civil contempt in enforcing court orders issued in
civil proceedings so that a peace officer is not placed in the position
of having observed a clearly non-violent violation of a civil court order
but is placed in a position where such violation can be interpreted as
a criminal action.
23. Sponsor or support legislation which would amend Penal Code Section 13720
to provide for a defined expiration date on the face of a "stay away"
restraining order so it is clear to a peace officer, particularly when
the court is closed, whether a given order is still in force or not.

24. Sponsor or support legislation which would amend Evidence Code
Section 712 to prohibit objection to the introduction of an affidavit
from a person withdrawing blood in lieu of testimony without good
cause similar to the language presently in Penal Code Section 872.
25. Sponsor or support legislation which would add phlebotomists to the
list of persons authorized to withdraw blood for the purpose of making
a blood alcohol test.
26. Sponsor or support legislation which would reintroduce legislation
similar to SB 1291 of the 1983-1984 Regular Session of the Legislature
which passed but was vetoed which would 'establish a demonstration
program to test the effectiveness of Probation Classification programs.
27. Oppose any legislation which would have the effect of removing payments- .
on behalf of delinquents from the AFDC-FC program or would otherwise
increase county costs for placement of such wards.
28. Sponsor or support legislation which has the effect of increasing safety
standards for vehicles licensed to haul hazardous materials in order to
reduce the incidents of spills of such hazardous materials on highways
due to improperly maintained vehicles.
29. Sponsor or support legislation which would improve the ability to identify
a hazardous material as distinguished from a non-hazardous material
quickly and easily so as to avoid situations where highways are closed
and traffic is backed up needlessly while extensive testing of a spilled
material is undertaken only to find that the material was completely
harmless.

SUBJECT: Adequate Funding for Social Service Programs
In its review of the County's Legislative Program proposed for 1985,
Board members commented on the mandates imposed on the County through the
enactment of legislation which does not provide for adequate funding. It was
noted that many of the County's social service programs were at risk because
of unrealistic program requirements that are inadequately funded. Board members
expressed agreement that this matter should be further reviewed.
IT IS BY THE BOARD ORDERED that the County Welfare Director is REQUESTED
to review legislation and submit amendments pertinent to social service programs,
particularly with respect to SB 14.
