DECLARE that this Board intends to convey by Grant Deed from Contra Costa County to the Discovery Bay
Community Services District (DBCSD) County-owned fee real property described within County Services Area LL-2
Zones 35, 57, and 61 and the Discovery Bay West Parking District in the attached Notice and that said property is not
required for County use.
DECLARE that this Board hereby sets Tuesday, April 7, 2009 at 9:30 a.m. or thereafter, in the Board’s Chambers, in
the County Administration Building, Martinez, California, as the time and place it will meet to consummate this
conveyance by a four-fifths vote.
DIRECT the Clerk of the Board to have the Notice published one time, at least one week preceding the date set for
the board item in the Contra Costa Times, a newspaper of general circulation (pursuant to Government Code § 6061).
FISCAL IMPACT:
There is no cost associated with this action. Upon transfer of the fee areas to the Discovery Bay Community Services
District all operating costs will be the responsibility of the District.

Subject:Notice of Intention to convey by Grant Deed to Discovery Bay Community Services District, Discovery Bay area. (Gov. Code
§25365)
BACKGROUND:
The basis for this conveyance is LAFCO Resolution No. 7-13 and LAFCO Staff Report dated December 12, 2007
that directed the DBCSD to assume lighting, landscaping and maintenance responsibilities for County Services Area
LL-2 Zones 35, 57, and 61 and the Discovery Bay West Parking District. Along with maintenance responsibilities,
property rights for parks and parking lots were also to be transferred to DBCSD as well. The transfer is a ministerial
action and thus not subject to CEQA.
CONSEQUENCE OF NEGATIVE ACTION:
Without Board approval, these properties could not be conveyed to the Discovery Bay Community Services District.
