HomeMy WebLinkAboutMINUTES - 11271984 - 1.41 ORDINANCE NO. 84-56 (On Airport and_Heliport_Uses ) The Contra Costa County Board of Supervisors ordains as .follows (omitting the parenthetical footnotes from the official text of the enacted or amended provisions of the County Ordinance Code) : SECTION I_ Chapter 86-2 of the County Ordinance Code , is repealed , revised , and re-enacted to read : Chupter_86_2 Aireort_Estnblishment ARTICLE 86-2. 2 General 86-2 . 202 Short _Title. This chapter shall be known and may be cited as the airport land use ordinance of Contra Costa County . (Ord . 84-__51 : prior code 58200 : Ord . 525 . ) 86_2 . 204 Purpose _ This chapter is adopted under the Conservation and-Planning Act of the State of California and Sections 26027 and 26028 of the Government Code of the State of California, to provide for the establishment of airports and heli - ports as conforming uses in suitable areas in the unincorporated territory of this county . The Board of Supervisors deems it necessary to create an airport land use zoning chapter to promote the health , safety, and general welfare of the inhabitants of this county by preventing the creation or establishment of airport hazards , thereby protecting the lives and property of the users of public and private airport and heliports and of the occupants of the land in the vicinity of these aviation facilities . (Ord. 84-___51 : prior code 58201 : Ord . 525 . ) ARTICLE 86-2 . 4 Definitions 86-2 .402_ General . Unless otherwise specifically, provided , or required by the context , the following terms have these meanings for the purposes of this chapter . (Ord . 84----Si . ) 86-2 . 404 Airport_ "Airport " means any area of land or water designed and set aside for the landing and taking off of aircraft . (Ord. 84-___51 . ) 86-2 .406 Public Use Airport . "Public Use Airport" means a publicly or privately owned airport that allows or offers the use of its facilities by or to , the public without prior notice or spe- cial invitation or clearance. (Ord. 84- 51. ) ORDINANCE NO. 84- 56 --------------------- 00 090 • J 86-2 . 408 Private Use Airport . "Private Use Airport" means , a privately owned airport~not open to. the general public . (Ord . 84- 51 . ) 86_2 . 410 Expansion . "Expansion" means any construction of ' a new runway or 'the extension or realignment of an existing runway, addition of ancillary uses , change from private to public use , or the addition of airplane hangers , tie-downs , or other storage facilities . (Ord . 86-2 . 412 Aircraft . "Aircraft" means any manned contrivance used-or-aesTgnea-Tor-navigation of , or flight in , the air including but not limited to fixed wing, auto-gyro, ultra-lights , experimental aircraft , blimps , and gliders . Manned ligher-than- air balloons shall not be considered aircraft . (Oral. 84----51 . ) 86-2 . 414 Heliport . "Heliport" means any area of land , water , or . structuure , set aside for the landing and taking off of helicopters . (Ord . 84- 51 . ) ARTICLE 86-2 . 6 Planning-Commission 86-2 . 602 Authority. When proposed in its territorial area of jurisdiction , ihe_involved county or area planning commission shall : ( 1 ) Hear and formulate recommendations to . the Board on appli - cations for approval of construction plans , for the purposes of compliance with Government Code §21661 . 5 (regarding approval of construction plans ) and applications for approval of land acquisi- tion plans for the purposes of compliance with Government Code 521661 . 6 ( regarding acquisition of unincorporated territory by a public agency for expansion of an existing publicly-owned airport ) . (2 ) Bear and decide all requests for land use permits under by this chapter . (Ord. 84----51 . ) ARTICLE 86-2 . 8 Location 86-2 . 802 Suitable areas . (1 ) Notwithstanding the provisions of Division 82, an airport or heliport may be located within any area zoned Agricultural (A- ) , Light Industrial (L- I ) , Heavey Industrial (H-I ) , Water-Recreational (F-1 ) , Planned Unit Development (P-1 ) , Unrestricted (U) , or Controlled Manufacturing (C-M) . -2- ORDINANCE_NO__84-56 00 091 (2 ) The Board finds that areas not zoned as specified in this ' section are not suitable for airports , heliports , or aviation facilities . (Ord. 84-___§1 : prior code 58203 : Ord . 525 . ) ; 86-2 . 8_04 Exceptions_ County or City owned airports and heli - ports are exempt Trom the permit requirements of this chapter . Heliports operated by public agencies for the maintenance and pro- tection of the general health , safety and welfare of the residents of Contra Costa County are exempt from the permit and location requirements of this chapter . (Ord . 84- §1 . ) ARTICLE. 86-2 . 10 Permits 86_2 . 1002 _Requirement . No person shall establish , maintain, or expand an airport or heliport in this county without first obtaining a land use permit . Except as provided in this chapter , no airport or heliport use is lawful until a land use permit for it has been approved by the planning commission. (Ord. 84- 51 . ) 86-2 . 1004 Areas . Applications maybe made for this chapter ' s land use permits where the involved land and premises are covered by the regulations of Division 82 and 84 and located in the A- , L-1 , H-11 F-19 P-1 , U, or C-M zoning districts . (Ord . 84---§1 . ) 86-2 . 1006 Applications _ All applications for permit approv- al shall include thfo e llowing: (1) Scale drawings and plans showing: a. Airport or heliport layout plans indicating proposed runways , taxiways , aircraft tie-down areas , hangers , 'and other proposed buildings and improvements . b. The boundary of the site , existing topography , grading proposed to accommodate airport construction and improvements , and the distance to nearby structures and utility lines . ( 2 ) A vicinity map showing the airport or heliport location on a USGS quadrangle map and any other airport locations within three miles . (3) A written description of the length of runways , the number and type of aircraft to be based at the airport or helI - port , hours of operation, any proposed lighting, and whether the airport is proposed for public use or private use. ( 84- S1. ) -3- ORDINANCE NO. 8 y---------4-ak 00 092 ' 86-2 . 1008 Review. Pursuant to this chapter , the involved planning commission shall review land use permit applications for approval , modification or denial , in public hearing pursuant to and otherwise regulated by the land use permit provisions of chap- ters 26-2 and 82-6 . SECTION II . Section 86-4. 002 of the Ordinance Code is amended to read------- 86_4 . 002 Short title. This chapter shall be known and may be cited as the Buchanan Field Airport Zoning Ordinance of Contra Costa County . (Ord. 84---52 : prior code 58210 : Ord . 976. ) SECTION III EFFECTIVE DATE. This ordinance becomes effective 30 ----------- ------------- days after passage , and within 15 days of passage shall be published once with the names of supervisors voting for and against it in the LgrjtLa C.Qa:La_ TimDvc __, a newspaper published in this County . Page P-10 of the County's 1978 Zoning Map (Ord. No. 78- 93) is amended by re-zoning the land in the above area shown shaded on the map(s) attached hereto and incorporated herein (see also County Planning Department File No. 2560-RZ ) FROM: Land Use District R-20/9D-1 ( Single Family Residential ) TO: Land Use District P-1 ( Planned Unit Development ) and the Planning Director shall change the Zoning Map accordingly, pursuant to Ordinance Code Sec. 84-2.003. v O •ecce p � r SECTION 11.
