SUBJECT: Exception to Drainage Fee Credit and Reimbursement Policy for Drainage Area 15A
for Group II Real Estate, Inc. Tice Valley Shops Development, Walnut Creek,
Project No. 7559-6D8572.
Specific Requests or Recommendations & Background & Justification
RECOMMENDATION
As the governing body of Contra Costa County and the Contra Costa County Flood Control and
Water Conservation District:
I. APPROVE an exception to the Board's Adopted Drainage Fee Credit and Reimbursement
Policy for Flood Control Drainage Area 15A permitting a reimbursement to a developer,
and
2. AUTHORIZE a reimbursement of $18,565.50 to Group II Real Estate, Inc. of Walnut Creek,
the developer of the Tice Valley Shops, and
3. AUTHORIZE the return of $25,850 in drainage fees already collected from the developer
by the City of Walnut Creek and transferred to the County Auditor-Controller, and
4. APPROVE, subject to concurrence by the City of Walnut Creek, the modification of the
County-City-District Olympic Boulevard Storm Drain Agreement to permit this one-time
disbursement of drainage fees prior to repayment of the $90,000 due the City of Walnut
Creek and the $100,000 due the County under said agreement.
BACKGROUND
A long-standing drainage problem in the vicinity of Olympic Boulevard and Tice Valley
Boulevard was solved in 1979 by the installation of a storm drain funded by drainage fees,
developer contributions, road funds, and loans from the City of Walnut Creek and the County
of $100,000 each. Flood Control Drainage Area 15A was established and a drainage ordinance
was adopted as a means of repaying the above loans. At the present time, only $10,000 has
been repaid to the city of Walnut. Creek which, under the terms of the agreement, is to be
fully reimbursed prior to the County.
In 1980, after formation of Drainage Area 15A and after execution of the above City-County-
District Agreement, the Board adopted a Drainage Fee Credit and Reimbursement Policy which
stipulates, "Only governmental agencies loaning money for the installation of the adopted
drainage plan will be eligible for reimbursement from fees."

The Tice Valley Shops development in the City. of Walnut Creek was approved with the condition
of installing Line D-1 in Drainage area 15A, but the conditions of approval limited the
developers ' financial committment to his drainage fee obligation. : T.his.,condition was
imposed in 1980 by the City of Walnut Creek :at the same. time as the Board adopted the
Drainage Fee Credit and Reimbursement Policy. Due to- the severity of the present drainage
problem which Line D-1 will solve and the concurrent.time frame of.the adopti.on of the policy
and the approval of the Tice Valley Shops development, we recommend a one-time exception to
this policy statement.
The developer has obtained three bids for the work with the lowest bid being $42,100 from
B and P Engineered Excavating, Inc. The bid price is a reasonable bid for the work.

Approved Recommendations Nos . 1 , 2, and 3.
Agreed in concept to loan $18, 565. 50 to the Drainage Area from the
Flood Control District revolving fund . Public Works Director is to
submit this matter to the Board when there are four or more Board
members present.
